NOTICE OF SALE UNDER POWER
By virtue of the power of sale contained in the certain Security Deed ("Security Deed") from Ernest Wiggins (hereinafter the "Grantor") to Security National Bank dated July 21, 1989, and recorded July 24, 1989, in Deed Book 1774, Page 279, of the records of the Clerk of Superior Court of Bibb County, Georgia ("Security Deed"); then modified pursuant to those certain Modification Agreements recorded in Deed Book 2788, Page 281, in Deed Book 5283, Page 67, in Deed Book 5441, Page 240, in Deed Book 5638, Page 215, in Deed Book 5908, Page 39, and in Deed Book 8225, Page 352, aforesaid records; then assigned to JTS Capital 3 LLC by instrument recorded at Deed Book 10527, Page 282, aforesaid records; then assigned to Roswell Properties, L.L.C., Ltd. (hereinafter the "Grantee") by instrument recorded at Deed Book 11209, Page 348, aforesaid records, originally having been given to secure a Note in the amount of $25,000.00, certain property will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door at Liberty County, Georgia, within the legal hours of sale on the first Tuesday in JANUARY 2026 (January 6, 2026), to wit, the property described in said deed:
All that tract or parcel of land lying and being in the East Macon District of Bibb County, Georgia, and being a part of the subdivision of the James A. Kelly Lands, plat of which is recorded in Plat Book 3, Folio 88, Clerk's Office, Bibb Superior Court, and by reference thereto made a part hereof. The property herein conveyed is 1 acre, more or less, in said subdivision and bounded as follows: On the south by Albany Avenue, on the east by Lot 1 in Block 8, on the north by Eastman Avenue, and on the west by Park Avenue.
Also, all those lots in the East Macon District of Bibb County, Georgia, and being a part of the subdivision of the James A. Kelley Lands, plat of which is recorded in Plat Book 3, Folio 88, Clerk's Office, Bibb Superior Court, and by reference made a part hereof. The property herein conveyed is described as Lots 1, 2, 3 and 4 in Block 8 and lies between Eastman Avenue and Albany Avenue in said subdivision.
Being the same property conveyed by deed recorded in Deed Book 1492, page 397, Clerk's Office, Bibb Superior Court.
Also, all that tract or parcel of land lying and being in East Macon, District of Bibb County, Georgia, and being a part of the James A. Kelly Lands, plat of which is recorded in Plat Book 3, folio 88, Clerk's Office, Bibb Superior Court, and by reference thereto is made a part hereof. The property herein conveyed in described as beginning at the southeast corner of Lot 21 in Block 3 and from this point running thence East along Dublin Avenue to Park Avenue thence running in a northerly direction along the west side of Park Avenue to Eastman Avenue; thence running west along Eastman Avenue to the northwest corner of Lot 18 in Block 4; thence running in a southeasterly direction to the northeast corner of said Lot 18 in Block 4 to Cordele Avenue; thence south east to the northeast corner of Lot 22, in Block 3, thence south to the point of beginning.
The debt secured by said Security Deed has been and is hereby declared due and payable in full by reason of default under the terms and provisions of said Security Deed and the terms of the Note and agreements secured thereby. The debt remaining in default and unpaid, this sale will be made for the purpose of paying the indebtedness and interest thereon, together with any other indebtedness due and owing by Grantor to Grantee Roswell Properties, L.L.C., Ltd., all expenses of this sale, including attorney's fees, notice of intent to collect attorney's fees having been given.
The entity that has full authority to negotiate, amend, and modify all terms of the mortgage with the debtor is: Roswell Properties, L.L.C., Ltd., 100 North Center Street, Newton Falls, Ohio 44444, Phone: via Leon S. Jones at 404-564-9300. Please understand that the secured creditor is not required to negotiate, amend, or modify the terms of the mortgage instrument.
Said property will be sold subject to: (a) any outstanding ad valorem taxes including taxes which are a lien, but not yet due and payable, (b) any matters which might be disclosed by an accurate survey and inspection of the property, and (c) any assessments, liens, security deeds, encumbrances, zoning ordinances, restrictions, covenants and other matters of record superior to the Security Deed first set out above.
On June 27, 2025, the Court of Appeals of Georgia issued an opinion upholding the validity and enforceability of Grantee's Security Deed on the subject property. To the best of the knowledge of Grantee Roswell Properties, L.L.C., Ltd., title to said property is vested in the name of First American Services LLC as Trustee of the 1154 Magnolia Trust.
