NOTICE OF SALE UNDER POWER
STATE OF GEORGIA, COUNTY OF BIBB
By virtue of a Power of Sale contained in that certain Security Deed from David Venegas and Darion Visniski to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS NOMINEE FOR NEW AMERICAN FUNDING, LLC, dated May 22, 2023 and recorded on May 25, 2023 in Deed Book 11583, Page 156, in the Office of the Clerk of Superior Court of Bibb County, Georgia, said Security Deed having been given to secure a Note of even date, in the original principal amount of Two Hundred Eighty Thousand Four Hundred Twenty-Three and 00/100 dollars ($280,423.00), as transferred to New American Funding, LLC via Assignment recorded at Deed Book 12262, Page 1, with interest thereon as provided therein, will be sold at public outcry to the highest bidder for cash before the courthouse door of Bibb County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in December, 2025, all property described in said Security Deed including but not limited to the following described property:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 175 OF THE 4TH LAND DISTRICT OF MACON-BIBB COUNTY, GEORGIA AND BEING KNOWN AND DESIGNATED AS LOT 8, BLOCK "F", BEVINWOOD SUBDIVISION-SECTION 1, AS SHOWN ON A PLAT OF A SUBDIVISION SURVEY THEREOF, AND RECORDED IN PLAT BOOK 35, PAGE 139, CLERK'S OFFICE, BIBB SUPERIOR COURT, WHICH PLAT BY THIS REFERENCE THERETO IS INCORPORATED HEREIN FOR A MORE COMPLETE AND ACCURATE DESCRIPTION OF SAID LOT NO. 8 HEREBY CONVEYED AND ALSO A TRACT OF LAND LOCATED IMMEDIATELY EAST OF SAID LOT 8 IN BLOCK "F" AND BEING SHOWN ON A PLAT RECORDED IN SAID CLERK'S OFFICE IN PLAT BOOK 39, PAGE 89 WHICH REFERENCE IS MADE AND BEING DESIGNATED ON THE LAST MENTIONED PLAT AS "VINSON TO THOMAS F. HAMLIN".
THE TRACT OF LAND HEREINABOVE CONVEYED IS MORE PARTICULARLY DESCRIBED AS BEGINNING AT A POINT ON THE SOUTHERLY SIDE OF BEVIN DRIVE WHERE THE LINE BETWEEN LOTS 7 AND 8 IN BLOCK "F" INTERSECTS SAID BEVIN DRIVE; THENCE, RUN IN AN EASTERLY DIRECTION 120 FEET; THENCE, SOUTHERLY A DISTANCE OF 299.7 FEET, MORE OR LESS, TO THE FENCE WHICH SEPARATES THE PROPERTY OF B.F. VINSON FROM THAT FORMERLY OWNED BY MRS. GRADY WILCOXON, THENCE, WESTERLY ALONG SAID FENCE 120 FEET; THENCE, NORTHERLY ALONG THE LINE BETWEEN LOTS 7 AND 8 IN BLOCK "F" 299.5 FEET TO THE POINT OF BEGINNING.
 
ALSO HEREBY CONVEYED IS ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 175 OF THE 4TH LAND DISTRICT OF MACON-BIBB COUNTY, GEORGIA AND BEING KNOWN AND DESIGNATED AS THE EASTERLY HALF LOT 7, BLOCK "F", BEVINWOOD SUBDIVISION-SECTION 1, AS SHOWN ON A PLAT OF A SUBDIVISION SURVEY THEREOF, AND RECORDED IN PLAT BOOK 35, PAGE 139, CLERK'S OFFICE, BIBB SUPERIOR COURT, WHICH PLAT BY THIS REFERENCE THERETO IS INCORPORATED HEREIN FOR A MORE COMPLETE AND ACCURATE DESCRIPTION OF SAID EASTERLY HALF LOT 7, BLOCK "F" HEREBY CONVEYED. THE EASTERLY HALF OF LOT 7, BLOCK "F" FRONTS THE SOUTHERLY SIDE OF BEVIN DRIVE 50 FEET AND EXTENDS BACK IN A SOUTHERLY DIRECTION A DISTANCE OF 299.5 FEET, MORE OR LESS, TO THE PROPERTY FORMERLY OWNED BY MRS. GRADY WILCOXON AND IS 50 FEET IN WIDTH ACROSS THE REAR.

Said property may more commonly be known as 6573 Bevin Dr, Macon, GA 31216.
 
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney's fees having been given).
 
The individual or entity that has full authority to negotiate, amend and modify all terms of the loan is New American Funding, LLC, New American Funding, c/o Home Retention Department, 8201 North FM 620, Suite 120, Austin, TX 78726, 800-893-530.
Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: a) zoning ordinances; b) matters which would be disclosed by an accurate survey or by an inspection of the property; c) any outstanding ad valorem taxes, including taxes, which constitute liens upon said property whether or not now due and payable; d) special assessments; e) the right of redemption of any taxing authority; f) all outstanding bills for public utilities which constitute liens upon said property; g) all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed. To the best of the knowledge and belief of the undersigned, the owners and party in possession of the property are David Venegas and Darion Visniski and or tenant(s). The sale will be conducted subject to 1) confirmation that the sale is not prohibited under the U.S. Bankruptcy code and 2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
