NOTICE OF INTENT TO REQUEST RELEASE OF FUNDS
FOR TIERED PROJECTS AND PROGRAMS

On or after January 8, 2026, the Lexington-Fayette Urban County Government (LFUCG) will submit a request to the U.S. Department of Housing and Urban Development (HUD) for the release of Federal Community Development Block Grant (CDBG) funds under Title I of the Housing and Community Development Act of 1974, as amended as well as Federal HOME Investment Partnerships funds under the National Affordable Housing Act of 1990 to undertake the following projects:
Single Family Housing Rehabilitation Program – Program will provide low-interest loans to low-income homeowners and deferred loans to very low-income homeowners for the purpose of bringing their homes into code compliance and improving energy efficiency. Tier 2 site-specific reviews will be completed for those laws and authorities not addressed in the Tier 1 Broad review for each address under this program when addresses become known. Rehabilitation Program of homeowner occupied single family homes, 24 CFR Part 58.35 (a)(3)(i). Approximately 18 units will be rehabilitated during this year. Total estimated project cost: $865,370.89. Approximately $142,247 CDBG and $723,123.89 HOME funds will be used.
CHDO – Fayette County Local Development Corporation – The Fayette Local Development Corporation will acquire two properties and construct two 3-bedroom, 2.5 bath single family units, creating 2 new units for permanent rental to low- and moderate-income families in need, 24 CFR 58.35(a)(i), and subject to laws and authorities at §58.5 (4)(i.). Total estimated project cost: $572,770.00. Approximately $180,956.00 HOME funds will be used.
The activities proposed are categorically excluded under HUD regulations at 24 CFR Part 58 from National Environmental Policy Act (NEPA) requirements per 58.35(a). An Environmental Review Record (ERR) that documents the environmental determinations for this project is on file at LFUCG Division of Grants and Special Programs, 6th Floor, 200 East Main Street, Lexington, KY 40507 and may be examined or copied weekdays 8 A.M. – 5 P.M. Monday through Friday or if the review was completed in HEROS at https://www.hudexchange.info/programs/environmental-review/environmental-review-records/.
PUBLIC COMMENTS
Any individual, group, or agency may submit written comments on the ERR to the LFUCG Division of Grants and Special Programs at 200 East Main Street, 6th Floor, Lexington, KY 40507 or grants@lexingtonky.gov. All comments received by January 8, 2026, will be considered by LFUCG prior to authorizing submission of a request for release of funds. Comments should specify which Notice they are addressing.
ENVIRONMENTAL CERTIFICATION
The LFUCG certifies to HUD that Linda Gorton in her capacity as Mayor consents to accept the jurisdiction of the Federal Courts if an action is brought to enforce responsibilities in relation to the environmental review process and that these responsibilities have been satisfied. HUD, Kentucky Office approval of the certification satisfies its responsibilities under NEPA and related laws and authorities and allows the LFUCG to use HUD program funds.
OBJECTIONS TO RELEASE OF FUNDS
HUD, Kentucky Office will accept objections to its release of funds and LFUCG's certification for a period of fifteen days following the anticipated submission date or its actual receipt of the request (whichever is later) only if they are on one of the following bases: (a) the certification was not executed by the Certifying Officer of the LFUCG; (b) the LFUCG has omitted a step or failed to make a decision or finding required by HUD regulations at 24 CFR part 58; (c) the grant recipient or other participants in the development process have committed funds, incurred costs or undertaken activities not authorized by 24 CFR Part 58 before approval of a release of funds by HUD, Kentucky Office; or (d) another Federal agency acting pursuant to 40 CFR Part 1504 has submitted a written finding that the project is unsatisfactory from the standpoint of environmental quality. Objections must be prepared and submitted in accordance with the required procedures (24 CFR Part 58, Sec. 58.76) and shall be addressed to HUD, Kentucky Office LouisvilleRROF@hud.gov. Potential objectors should contact HUD to verify the actual last day of the objection period.
