Final Notice and Public Explanation of a Proposed Activity in a Wetland To: All interested Agencies, Groups, and Individuals This is to give notice that HUD under 24 CFR Part 50 has determined that the following proposed action under Multifamily Accelerated Processing (MAP) Section 221(d)(4) New Construction, FHA# 084-35430 is located within wetland areas, and HUD will be identifying and evaluating practicable alternatives to locating the action within the wetlands and the potential impacts on the wetlands from the proposed action, as required by Executive Order 11990, in accordance with HUD regulations at 24 CFR 55.20 in Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands. The proposed project known as Prairie Wolf Flats, is located at the southeast Intersection of West 175th Street and South Pflumm Road, in Overland Park, Johnson County, Kansas 66062. According to the Johnson County Assessor's Office, the Subject Property is identified as Parcel Number NF241427-1008. The Subject Property is located in a rural area and consists of 17.708-acres to be developed with 300 units within eight buildings, with a total of 531 parking spaces. Amenities proposed include a clubhouse with on-site leasing office, community lounge, game room, business center, fitness center and yoga studio, an outdoor amenity center with resort-style pool, grilling stations, cabanas, sports court, and walking trails. Approximately 1.24-acres of non-jurisdictional wetlands, including one freshwater pond, will be permanently impacted during constriction and an additional 515-linear feet of a jurisdictional stream (Within the City public Street right-of-way) will be indirectly impacted during construction. Impacts during construction include filling and impounding the wetlands. Multiple best management practices are in place to lessen the indirect impacts to the jurisdictional stream as well as USACE nationwide Permit 29 – Residential Developments. Currently, the wetlands and pond areas to be disturbed function to provide water storage, flood protection, habitat to flora and fauna, reduce erosion, and attenuate pollutants. No rare or unique natural resource conditions are known to occur within the property boundary. HUD has considered the following alternatives and mitigation measures to be taken to minimize adverse impacts and to restore and preserve natural and beneficial values: The overall site/grading footprint was originally conceptualized to be larger, with the creation of multiple stormwater management ponds to service the project on the southern portion of the parent parcel as well as having to retrofit the existing stormwater management pond and outfall. This alternative was rejected. The project as originally proposed was modified to reduce wetland impacts. Additional direct fill impacts in the wetlands/open water were minimized by reducing the overall project scope to the maximum extent practicable, while also accommodating the requirements to provide adequate stormwater management. The current stormwater management pond occurs in a naturally low-lying area. Construction activities will be completed in compliance with all local, state, and federal permitting requirements. In addition, modifications to the stormwater outfall pipes and grading to pull these pipe systems back away from the jurisdictional streams and have included rip-rap at the end sections to reduce risk of erosion. No additional modifications are necessary to minimize impacts to natural values. The no action alternative was also considered. Under this alternative, HUD does not insure the proposed development under the Section 221(d)4 program. In the absence of the proposed project, the subject property would remain vacant and underutilized or be redeveloped for some other residential/commercial purpose. HUD has reevaluated alternatives to building in the wetlands and has determined that it has no practicable alternative. Environmental files documenting compliance with Executive Order 11990, are available for public inspection, review and copying upon request at the times and location delineated in the last paragraph of this notice for receipt of comments. There are three primary purposes for this notice. First, people who may be affected by activities in the wetland and those who have an interest in the protection of the natural environment should be given an opportunity to express their concerns and provide information about these areas. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about wetlands can facilitate and enhance Federal efforts to reduce the risks and impacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in wetlands, it must inform those who may be put at greater or continued risk. Written comments must be received by HUD at the following address on or before May 3, 2026.
