NOTICE OF SALE CIVIL ACTION NO. 2023-CP-07-01498 BY VIRTUE of a decree heretofore granted in the case of: United States of America, acting through the Rural Housing Service or successor agency, United States Department of Agriculture v. The Personal Representative, if any, whose name is unknown of the Estate of Susan Rhea Martin; and any other Heirs-at-Law or Devisees of Susan Rhea Martin, Deceased, their heirs, Personal Representatives, Administrators, Successors and Assigns, and all other persons entitled to claim through them, and all unknown persons with any right, title or interest in the property described in the complaint herein; also any persons who may be in the military service of the United States of America, being a class designated as John Doe; and any unknown minors or persons under a disability being a class designated as Richard Roe, Michael S. Provo, and Kyle E. Jones, I, the undersigned Special Referee for Beaufort County, will sell on September 2, 2026 at 11:00 a.m. at the Beaufort County Courthouse, 102 Ribaut Road, Room 212, Second Floor, Beaufort, South Carolina to the highest bidder: All that certain piece, parcel or lot of land, with improvements thereon, situate, lying and being on Lady's Island, Beaufort County, South Carolina, being shown and designated as Lot Two (2) of Pepper Hill Subdivision on a plat prepared by R.D. Trogdon, Jr., RLS, dated July 21, 1987 and recorded in the Office of the Register of Deeds for Beaufort County, South Carolina in Plat Book 35 at Page 19. For a more complete description of said property, reference may be had to an individual plat prepared by David S. Youmans, RLS, dated January 10, 2003 and recorded the said Beaufort County Records in Book 1705 at Page 1484. This being the same property conveyed to Susan Rhea Martin by deed of Alex A. Smith, said deed being dated November 14, 2018 and recorded in the Office of the Register of Deeds for Beaufort County on November 29, 2018 in Book 3717 at Page 2789. Thereafter, Susan Rhea Martin died Testate and her Last Will and Testament was submitted for probate under Estate No.: 2019-ES-07-00354. TMS No.: R200 005 000 0096 0000 Property Address: 120 Springfield Road, Beaufort, South Carolina 29907 a/k/a 120 Springfield Road, Ladys Island, South Carolina 29907 SUBJECT TO ASSESSMENTS, BEAUFORT COUNTY AD VALOREM TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES. TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Special Referee for Beaufort County at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent as evidence of good faith, same to be applied to purchase price in case of compliance, but to be forfeited and applied first to cost and then to Plaintiff's debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within thirty (30) days, then the Special Referee for Beaufort County may resell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). For complete terms of sale, attention is drawn to the Judgment of Foreclosure and Order for Sale on file with the Clerk of Court for Beaufort County. A personal deficiency judgment being waived, bidding will not remain open. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 3.500% per annum. Should the Plaintiff, Plaintiff's attorney or agent fail to appear on sales day, the property shall not be sold but shall be readvertised and sold at some convenient sales day thereafter when the Plaintiff, Plaintiff's attorney or agent is present. Plaintiff does not warrant its title search to purchasers at foreclosure sale or other third parties, who should have their own title search performed on the subject property.
