NOTICE OF SALE STATE OF SOUTH CAROLINA IN THE COURT OF COMMON PLEAS COUNTY OF BEAUFORT CASE NO.: 2024-CP-07-01187 U.S. Bank Trust National Association, as Trustee for Chateau NOTICE OF SALE Series VI Trust, Deficiency Judgment Waived Plaintiff, v. Kilian Griffith; Broad Creek Landing Horizontal Property Regime, Inc., Defendant(s). _______________________________ BY VIRTUE of the decree heretofore granted in the case of: U.S. Bank Trust National Association, as Trustee for Chateau Series VI Trust, vs. Kilian Griffith and Broad Creek Landing Horizontal Property Regime, Inc., the undersigned Master in Equity for Beaufort County, South Carolina, will sell on July 6, 2026 at 11:00 AM at the Beaufort County Courthouse, 102 Ribaut Road, Room 212, Beaufort, SC 29902, to the highest bidder: ALL that certain Apartment lying and being on Hilton Head Island, Beaufort County, South Carolina, and being known as APARTMENT 14 of the BROAD CREEK LANDING HORIZONTAL PROPERTY REGIME and being more particularly shown and described by reference to the Master Deed of The Uniflex Corporation establishing said Horizontal Property Regime, said Deed being dated the 18th day of May, 1982, and being recorded in the Office of the Register of Deeds for Beaufort County, South. Carolina, in Deed Book 348 at Page 1074, and by reference to an Amendment being recorded in Deed Book 349 at Page 817. ALSO, all the rights, privileges and common elements appertaining to the above described Apartment as set forth in the Master Deed and By-Laws of the Broad Creek Horizontal Property Regime. This being the same property conveyed to the within Mortgagor by deed of Paul L. Shepherd a/k/a Paul Shepherd being recorded in the Office of the Register of Deeds for Beaufort County, South Carolina simultaneously herewith. PROPERTY ADDRESS: 14 Three Mast Ln, Hilton Head Island, SC 29928 TMS#: R550 014 000 0887 0014 TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master in Equity, at conclusion of the bidding, five percent (5%) of his bid, in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to the Plaintiff's debt in the case of non-compliance. Should the last and highest bidder fail to comply with the other terms of the bid within thirty (30) days, then the Master in Equity may re-sell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder). No personal or deficiency judgment being demanded, the bidding shall not remain open after the date of sale and shall be final on that date, and compliance with the bid may be made immediately. Purchaser to pay for documentary stamps on the Deed. The successful bidder will be required to pay interest on the amount of the bid from date of sale to date of compliance with the bid at the rate of 4.62500% per annum. The sale shall be subject to taxes and assessments, existing easements and restrictions of record, and any other senior encumbrances. Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. In the event an agent of Plaintiff does not appear at the time of sale, the within property shall be withdrawn from sale and sold at the next available sales date upon the terms and conditions as set forth in the Master in Equity's Order and Judgment of Foreclosure and Sale or such terms as may be set forth in a supplemental order. This sale is subject to all title matters of record and any interested party should consider performing an independent title examination of the subject property as no warranty is given.
