YOU ARE HEREBY SUMMONED and required to answer the Amended Complaint in this action, a copy of which is herewith served upon you, and to serve a copy of your Answer to the said Amended Complaint upon the subscriber, Callison Tighe & Robinson, LLC, 1812 Lincoln Street, Suite 200, PO Box 1390, Columbia, SC 29202-1390, within thirty (30) days after service hereof, exclusive of the day of such service; and to file a copy with the court pursuant to Rule 5, SCRCP. If you fail to answer the Amended Complaint or otherwise appear and defend within the aforesaid time, the Plaintiff in this action will apply to the Court for the relief demanded therein, and judgment by default will be rendered against you for the relief demanded in the Amended Complaint.

NOTICE IS HEREBY GIVEN that an action is being commenced and is now pending in the Court of Common Pleas for Beaufort County upon a Complaint of the above-named Plaintiff against the above-named Defendants for the purpose of (a) reforming that certain deed dated July 28, 1998, between Joan Andrews Trifeletti and Richard Ford Dreves, as grantors, and William R. Gardner and Linda M. Gardner, as grantees, which deed was recorded on August 21, 1998, with the Beaufort County Register of Deeds in Deed Book 1078 at Page 876; (b) reforming that certain deed dated October 8, 2009, between Linda M. Gardner, as grantor, and William R. Gardner, as grantee, which deed was recorded on November 23, 2009, with the Beaufort County Register of Deeds in Deed Book 2910 at Page 474; and (c) quieting title to certain real property situated in Beaufort County as more fully described herein. The real property covered and affected by this action is situated in Beaufort County, South Carolina, and is described as follows: ALL that certain piece, parcel or lot of land, situate, lying and being on Fripp Island, Beaufort County, South Carolina, and shown and delineated as Lot 7, Block B of Subdivision 16 on a plat of Block B of Lake Village Subdivision No. 16, prepared by Warren H. Mackay, RLS, for Fripp Island Development Corporation, dated July 22, 1974, and recorded in the Office of the Register of Deeds for Beaufort County, South Carolina in Plat Book 23 at Page 15. SAVE AND EXCEPTING THEREFROM, however, a small parcel, or lot of land which was conveyed by Thomas L. Fouts to Robert F. Kraft and Suzanne M. Kraft, by deed dated April 17, 1978, and recorded in the Office of the Register of Deeds for Beaufort County, South Carolina in Deed Book 262 at Page 1647, said parcel or lot being shown and designated as Parcel "A" on a plat of the revision of Lots B7 and B8, Subdivision 16, Fripp Island, prepared by R. D. Trogdon, RLS dated August 3, 1977, and recorded in the Office of the Register of Deeds for Beaufort County, South Carolina in Deed Book 262 at Page 1649. ALSO: ALL that certain piece, parcel or lot of land, situate, lying and being on Fripp Island, Beaufort County, South Carolina, and shown and delineated as Parcel "B" on a plat of the revision of Lots B7 and B8, Subdivision 16, Fripp Island, prepared by R. D. Trogdon, RLS dated August 3, 1977, and recorded in the Office of the Register of Deeds for Beaufort County, South Carolina in Deed Book 262 at Page 1649.
For a more complete description as to metes, bounds, courses and distances reference may be had to that plat prepared by David E. Gasque, R.L.S. No. 10506, dated March 31, 2017 and entitled "Tree and Topographical Survey Lot 7 BLK-B S/D-16 Prepared for Mary Strong", a copy which is recorded in the office of the Register of Deeds for Beaufort County, South Carolina in Book 146 at 101 and are as follows: Beginning at an iron pipe found l" pinch top at the northwest right-of-way of Pintail Court and the westerly right-of-way of Remora Drive (50' R/W), said iron pipe found l" pinch top being the Point of Beginning. Thence from the Point of Beginning and continuing along the right-of-way of Remora Drive, along a curve to the left, having a radius of 1679.43 feet and an arc length of 53.44 feet, being subtended by a chord bearing of North 26 degrees 38 minutes 54 seconds West for a distance of 53.44 feet to a point; thence North 25 degrees 22 minutes, 56 seconds West, a distance of 67.35 feet to a ½" rebar found; thence leaving said right-of-way of Remora Drive the following five (5) courses and distances: 1. South 88 degrees 51 minutes 21 seconds East, a distance of 151.56 feet to a ½" rebar set; 2. South 46 degrees 01 minutes 52 seconds East, a distance of 42.40 feet to a ½" rebar found; 3. South 56 degrees 37 minutes 41 seconds West, a distance of 67.21 feet to a ½" rebar set; 4. South 31 degrees 54 minutes 37 seconds West, a distance of 61.65 feet to 1/:2" rebar found; 5. North 71 degrees 59 minutes 30 seconds West, a distance of 42.58 feet to the Point of Beginning.
Containing 0.29 acres (12785.38 Sq. Feet) and being more particularly shown and depicted on that certain Tree and Topographical Survey for Mary Strong, dated March 31, 2017, prepared by David E. Gasque, South Carolina Registered Land Surveyor No. 10506, Gasque & Associates Inc., Job# 4650 I. Said property is conveyed subject to all Restrictive Covenants of record as set forth in the Office of the Register of Deeds for Beaufort County, South Carolina. This is the same property conveyed to Mary E. Strong by Deed of William R. Gardner dated April 4, 2017, and recorded April 21, 2017, with the Beaufort County Register of Deeds in Book 3568 at Page 2061.
