NOTICE OF SALE Docket No. 2025-CP-07-02769 By virtue of a decree heretofore granted in the case of Montano Properties, LLC against NM South, LLC, et al., I, the undersigned Master in Equity for Beaufort County, will sell on Monday, May 4, 2026, at 11:00 a.m., at the Beaufort County Courthouse, 102 Ribaut Road, Beaufort, South Carolina, to the highest bidder: ALL that certain piece, parcel or lot of land situate, lying and being in Beaufort County, South Carolina and being shown and described as Lot J58 Colleton River Plantation, on a plat thereof entitled "A Plat of Colleton River Plantation J58, A Section Victoria Bluff, Beaufort County, South Carolina Total Acreage 9.760 Ac.", said plat being prepared by Thomas & Hutton Engineering Co., Savannah, GA Boyce L. Young SCRLS #11079, said plat being dated March 17, 1994, and recorded in the Office of the Register of Deeds for Beaufort County, South Carolina, in Plat Book 49 at Page 35. Said property is conveyed subject to all applicable rights, obligations, easements, restrictions and reservations as recorded in the Office of the Register of Deeds for Beaufort County, South Carolina, but it is provided, however, that it is not Montano Properties, LLC's intention hereby to extend to the premises conveyed any additional restrictions that do not already encumber the same. This being the same property conveyed to NM South, LLC by deed from Montano Properties, LLC dated August 20, 2024 and recorded on September 5, 2024 in Book 4364 at Page 1481, Beaufort County Records. TMS No. R600 025 00D 0009 0000 CURRENT ADDRESS OF PROPERTY IS: 28 Seven Oaks Drive Bluffton, South Carolina 29910 SUBJECT TO ASSESSMENTS, Beaufort COUNTY TAXES, EXISTING EASEMENTS, EASEMENTS AND RESTRICTIONS OF RECORD, AND OTHER SENIOR ENCUMBRANCES, IF ANY. TERMS OF SALE: The successful bidder, other than the Plaintiff, will deposit with the Master in Equity, at the conclusion of the bidding, Five per cent (5%) of the bid in cash or equivalent, as evidence of good faith, same to be applied to the purchase price in case of compliance, but to be forfeited and applied first to costs and then to Plaintiff's debt in the case of non-compliance. Should the last and highest bidder fail or refuse to make the required deposit at time of bid or comply with the other terms of the bid within 30 days, then the Master in Equity may resell the property on the same terms and conditions on some subsequent Sales Day (at the risk of the said highest bidder.) As a deficiency judgment is demanded, the bidding will remain open for a period of 30 days after the date of sale as provided by law in such cases.
