NOTICE OF SALE C/A No: 2025-CP-07-01281 455 PLANTATION CLUB VILLAS III HPR HOA INC, Plaintiff, v. Janet Kyes, and if deceased, the heirs of Janet Kyes, Jose Montenegro, and if deceased, the heirs of Jose Montenegro, Maria Montenegro, and if deceased, the heirs of Maria Montenegro, Douglas R. Bert, and if deceased, the heirs of Douglas R. Bert, Angelene A. Laut, and if deceased, the heirs of Angelene A. Terry A. Finger, as Special Referee for Beaufort County, will sell on February 11, 2026 at 10:00 AM, at the Law Office of Finger, Melnick, Brooks & LaBruce, PA, 35 Hospital Center Common, Suite 200, Hilton Head Island, South Carolina 29925, to the highest bidder: A 2.08% undivided interest in that certain Apartment and all of the personal property presently contained therein, lying and being on Hilton Head Island, Beaufort County, South Carolina, and being known as APARTMENT 455 of the PLANTATION CLUB VILLAS III HORIZONTAL PROPERTY REGIME NO. XXI and being more particularly shown and described by reference to the Master Deed of Heritage Properties of Atlanta, Inc., establishing said Horizontal Property Regime, said Deed being dated the 30th day of December, 1975, and being recorded in the Office of the Register of Deeds for Beaufort County, South Carolina, in Record Book 233 at Page 1173. Also, a 2.08% undivided interest for Use Periods 1 and 2 in all the rights privileges and common elements appertaining to the above-described Apartment. USE PERIODS 1 and 2 And a 2.08% undivided interest in that certain Apartment and all of the personal property presently contained therein, lying and being on Hilton Head Island, Beaufort County, South Carolina, and being known as APARTMENT 455 of the PLANTATION CLUB VILLAS III HORIZONTAL PROPERTY REGIME NO. The deposit will be applied towards the purchase price unless the bidder defaults, in which case the deposit will be forfeited. If the successful bidder fails, or refuses, to make the required deposit on the day of sale or fails or refuses to comply with the bid within 30 days, then the property will be resold at the bidder's risk. No personal or deficiency judgment being demanded, the bidding will not remain open after the date of sale, but compliance with the bid may be made immediately.
