Notice of Sale C/A No: 2025-CP-07-01542 BY VIRTUE OF A DECREE of the Court of Common Pleas for Beaufort County, South Carolina, heretofore issued in the case of Federal Home Loan Mortgage Corporation, as Trustee for the benefit of the Freddie Mac Seasoned Credit Risk Transfer Trust, Series 2020-3 vs. F Lea Wade; Hilton Head Plantation Property Owners Association, Inc.; The United States of America, by and through its Agency, the Internal Revenue Service I the undersigned as Master-in-Equity for Beaufort County, will sell on January 5, 2026 at 11:00 AM at Beaufort County Court House, Beaufort, South Carolina 29902 to the highest bidder: Legal Description and Property Address: ALL THAT CERTAIN piece, parcel or lot of land situate, lying and being in Hilton Head Plantation on Hilton Head Island, Beaufort County, South Carolina, more particularly described as Lot Number Thirty Nine (39) Foxbriar, Bear Creek Subdivision II, Hilton Head Plantation; said property having dimensions, metes and bounds as shown on the plat thereof recorded in the Register Of Deeds Office for Beaufort County, South Carolina, in Plat Book 26 at Page 151. THIS BEING the same property conveyed unto W. Mitchell Wade and F. Lea Wade, as joint tenants with right of survivorship, by virtue of a Deed from Thomas Pilkington and Hannelore Pilkington dated August 15, 1988 and recorded on September 12, 1988 in Book 510 at Page 248 in the Office of the Register of Deeds for Beaufort County, South Carolina. THEREAFTER, W. Mitchell Wade purported to convey his interest in the subject property unto F Lea Wade by virtue of a Deed dated June 21, 1989 and recorded June 22, 1989 in Book 531 at Page 1566 in the Office of the Register of Deeds for Beaufort County, South Carolina. Thereafter, W. Mitchell Wade passed away July 2, 2016, thereby vesting sole title to the subject property in F. Lea Wade as the surviving tenant. 12 Foxbriar Lane Hilton Head Island, SC 29926 TMS# R510-004-00B-0039-0000 TERMS OF SALE: For cash. Interest at the current rate of 3.25% to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Master-in-Equity for Beaufort County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Thirty (30) days, the Master-in-Equity for Beaufort County shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. As a personal or deficiency judgment is demanded, the bidding will remain open for a period of thirty (30) days pursuant to the S.C. Code Ann. Section 15-39-720 (1976). Plaintiff may waive any of its rights, including its right to a deficiency judgment, prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record. Neither the Court, nor Plaintiff, nor Plaintiff's counsel makes any warranty of title or representations with regard to the condition or existence of any improvements on the subject property. Prospective bidders may wish to assess these matters to their satisfaction prior to sale. Pursuant to Section 2410(c), Title 28, United States Code, the Defendant United States of America has a right to redeem the subject property within 120 days after the date of the foreclosure sale.
