NOTICE OF CLASS ACTION SETTLEMENT AND FINAL APPROVAL HEARING

This is a Court-approved notice via publication to inform you that a settlement has been reached in a wage-and-hour lawsuit between the Plaintiff David Diaz ("Plaintiff") and the Defendant Sun-Maid Growers of California ("Defendant" or "Sun-Maid"). You may or may not qualify for proceeds of this settlement. WHO IS INCLUDED: You may be entitled to money from this settlement, but only if you worked as a non-exempt California-based production employee (permanent or temporary) employed by Sun-Maid at its Kingsburg, California facility any time between December 14, 2014, and March 6, 2024 ("Class Period"). Individuals meeting this description are "Class Members". YOUR RIGHTS: If you believe you are a Class Member, and have not already received notice in the mail, please contact the Phoenix Settlement Administrators (the "Settlement Administrator") as soon as possible to confirm your eligibility or to ask for additional information. You may be asked to provide identifying information (such as your name, address, and Social Security Number or Individual Taxpayer Identification Number). Under the terms of the settlement, Class Members who do not opt out will release all claims that could have been alleged based on the factual allegations contained in the Diaz v. Sun-Maid lawsuit and the related Labor and Workforce Development Agency Letter, including but not limited to all of the following claims for relief during the Class Period: (1) alleged failure to provide meal periods or premium pay in lieu thereof; (2) alleged failure to provide rest periods or premium pay in lieu thereof; (3) alleged failure to pay minimum wages; (4) alleged failure to timely pay final wages at termination; (5) alleged failure to provide complete and accurate itemized wage statements; (6) alleged civil penalties under the Private Attorneys General Act ("PAGA"); and (7) alleged unfair business practices. Defendant denies that it violated the law. WHAT CAN YOU RECOVER: If you are a Class Member, your individual share of the settlement will be calculated based on the total number of weeks that you worked for Sun-Maid as described above. To determine the number of workweeks attributed to you and your specific recovery, you must contact Phoenix Settlement Administrators. If you are eligible, you may select one of the following options: 1. OPTING OUT: You may request to be excluded from the settlement. If you choose to do so, you will not be bound by the judgment and you will not receive any compensation from the settlement. To opt out, you must submit a written request for exclusion to notice@phoenixclassaction.com by January 26, 2026. Include your name, address, and a statement that you wish to be excluded from the class. 2. IF YOU DO NOTHING: If you do not request exclusion, you will remain in the class and be bound by the Court's judgment in this case, whether it is favorable or unfavorable to the class, and you will be entitled to settlement proceeds. If you did not already receive a written notice of the settlement, you must reach out to the Settlement Administrator to provide an updated address. You will have 120 days from the date of mailing to cash any check received, and if you do not cash it, the check will be cancelled and all funds associated with your cancelled check will be sent in your name to the State of California Unclaimed Property Fund, https://ucpi.sco.ca.gov/UCP. 3. OBJECT: you may object to the settlement by mailing a written statement of objection to the Settlement Administrator at the address above, which must be post-marked no later than January 26, 2026. It must contain your full name, dates of employment as an employee of Defendant, and signature; contain the case name and number of the Lawsuit; set forth the legal and factual basis for the objection; and identify any counsel representing you in connection with the objection. FINAL APPROVAL HEARING: The Court will hold a hearing to decide whether the settlement is fair and adequate. You may also appear at the hearing through your own attorney at your own expense. The hearing will take place February 24, 2026 at 3:30 p.m. in Department 403, located at 1103 O Street, Fresno, California 93721. You have the right to appear and object in person or through counsel, but attendance is not required. IMPORTANT TAX REPORTING NOTICE: The Settlement Administrator is required by the Internal Revenue Service (IRS) to report payments made under this settlement. If you believe you are a Class Member and have not received mailed notice, please contact the Settlement Administrator to provide your current mailing address and taxpayer identification information (such as a Social Security Number or Individual Taxpayer Identification Number).
