NOTICE OF HEARING OF CONVERSION TO A
WATER CONTROL AND IMPROVEMENT DISTRICT
To the residents and taxpayers of Tarrant County Fresh Water Supply District No. 2 (the "District") and to all the interested persons:
Notice is hereby given that the Board of Supervisors, at a meeting held on November 11, 2025, adopted a Resolution Declaring the Intent of the Board of Supervisors of Tarrant County Fresh Water Supply District No. 2 to Convert the District to a District Operating Under Chapter 51, Texas Water Code, The Publication of Notice Thereof and Certain Findings Related Thereto.
Tarrant County Fresh Water Supply District No. 2 will hold a public hearing regarding the conversion of Tarrant County Fresh Water Supply District No. 2 from a Fresh Water Supply District to a Water Control and Improvement District on February 12, 2026, at 12:00 p.m., at 4001 Maple Avenue, Suite 600, Dallas, Texas 75219.
All residents and taxpayers of the District and other interested persons are hereby invited to the public hearing at such location or by teleconference to offer testimony for or against the proposal for conversion contained in the Resolution stated in its entirety below.

RESOLUTION DECLARING THE INTENT OF THE BOARD OF SUPERVISORS OF
TARRANT COUNTY FRESH WATER SUPPLY DISTRICT NO. 2 TO CONVERT THE DISTRICT TO A DISTRICT OPERATING UNDER CHAPTER 51, TEXAS WATER CODE, THE PUBLICATION OF NOTICE THEREOF AND CERTAIN FINDINGS RELATED THERETO
WHEREAS, Tarrant County Fresh Water Supply District No. 2 (the "District") was created by Order of the Commissioners Court of Tarrant County dated March 18, 2025; and
WHEREAS, the District is organized under Article XVI, Section 59, of the Texas Constitution for any purpose authorized by Chapter 53 and Chapter 49 of the Texas Water Code, as amended and any other applicable law; and
WHEREAS, the District is located within the extraterritorial jurisdiction of the City of Fort Worth, Texas, Tarrant County; and
WHEREAS, the District held an election on November 4, 2025, which confirmed the District, appointed supervisors, and assumed powers of a road district pursuant to Article III, Sec. 52(B)(3); and
WHEREAS, pursuant to Sec. 51.040, Texas Water Code, any conservation and reclamation district created under Article XVI, Section 59, of the Texas Constitution, may be converted to a water control and improvement district operating under Chapter 51, Texas Water Code; and
WHEREAS, the Board of Supervisors desires to adopt a a resolution declaring that, in its judgement, pursuant to Sec. 51.040 of the Texas Water Code, conversion to a water control and improvement district operating under Chapter 51 of the Texas Water Code and Article XVI, Section 59 of the Texas Constitution would serve the best interest of the District and would be a benefit to the land and property included in the District; and
WHEREAS, the District intends to retain all of its powers as a fresh water supply district, including powers of a road district, and convert to a water control and improvement district pursuant to Chapter 51 of the Texas Water Code upon its own motion and operate under Chapters 49 and 51 of the Texas Water Code; and
WHEREAS, pursuant to Sec. 51.332, Texas Water Code, a water control and improvement district may increase a district's powers to include powers under Sec. 51.331 related to authority to dispose of waste and control storm water;
WHEREAS, pursuant to Sec. 51.332, Texas Water Code and 30 TEXAS ADMINISTRATIVE CODE §293.15 the District seeks to obtain Texas Commission on Environmental Quality ("TCEQ") approval to exercise additional wastewater and drainage powers ("Additional Powers"); and
WHEREAS, the District desires to acquire the Additional Powers; and
WHEREAS, Additional Powers will be of benefit to the District and the land included therein because the District is currently without sufficient wastewater services and drainage facilities to allow for the orderly development of the District; and
WHEREAS, 30 TEXAS ADMINISTRATIVE CODE §293.15 sets forth the application requirements for seeking TCEQ approval of the acquisition of Additional Powers; and
WHEREAS, the District's engineer has prepared a preliminary plan and preliminary engineering report that contains the information required by 30 TEXAS ADMINISTRATIVE CODE §293.15, which plan and report are incorporated herein by reference; and
WHEREAS, the District desires to submit its application to the TCEQ seeking approval of the acquisition of Additional Powers by the District; Now, Therefore
BE IT RESOLVED BY THE BOARD OF SUPERVISORS OF TARRANT COUNTY FRESH WATER SUPPLY DISTRICT NO. 2 THAT:
Section 1: The Board of Supervisors hereby authorizes the submission of an application to the TCEQ for the acquisition of Additional Powers by the District, such application to be prepared in accordance with the provisions of 30 TEXAS ADMINISTRATIVE CODE §293.15. The Board of Supervisors hereby finds that the Additional Powers requested will be of benefit to the District and the land included in the District for the reasons stated in detail in the recitals to this Resolution. This Resolution constitutes a petition to the TCEQ pursuant to 30 TEXAS ADMINISTRATIVE CODE §293.15.
Section 2: The Board of Supervisors authorizes submission to the TCEQ of its Order Canvassing Election and its Order Converting District to a Water Control and Improvement District upon the election and conversion.
Section 3: The President and Secretary of the Board of Supervisors; the District's engineer, Jones-Heroy & Associates, Inc.; and the District's attorney, Allen Boone Humphries Robinson LLP, are authorized and directed to do any and all things necessary and proper in connection with such application, including the filing of the application with the TCEQ.
