Under and by virtue of the Power of Sale contained in a Security Deed given by JAMES DAVID HOWARD to GB MORTGAGE LLC dated May 27, 2008 and recorded on June 10, 2008 in Book No. 9392, at Page No. 315, of the Muscogee, Georgia records, as last assigned to HGRF TRUST (the "Secured Creditor"), by assignment, conveying the after-described property to secure a Note of even date in the original principal amount of $40,500.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash in Muscogee County, before the Courthouse door, or at such place as may be lawfully designated as an alternate, and within the legal hours of sale on July 07, 2026, being the first Tuesday in July 2026, the following described property:
ALL OF HER INTEREST, THAT BEING A ONE-HALF (1/2), UNDIVIDED INTEREST IN AND TO ALL THAT LOT, TRACT OR PARCEL OF LAND LYING AND BEING IN COLUMBUS, MUSCOGEE COUNTY, GEORGIA, BEING KNOWN END DESIGNATED AS LOT TWENTY-SIX (26), BLOCK "L", SECTION ONE, OF THAT SUBDIVISION OF LAND KNOWN AS MARIDELE ESTATES, AS SAID LOT AND BLOCK ARE SHOWN ON A MAP OR PLAT OF SAID SUBDIVISION DATED MARCH 8, 1960, BY SIEGEL ENGINEERING COMPANY, AND RECORDED IN PLAT BOOK 23, PAGE 108, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGIA, AND TO WHICH REFERENCE IS MADE FOR THE PARTICULAR LOCATION AND DIMENSIONS OF SAID LOT.

SUBJECT TO ANY EASEMENTS OR RESTRICTIONS OF RECORD
Property Address: 5162 TRUSSELL AVE, COLUMBUS, GA 31904 (the "Property").
The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. Because the debt remains in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given).
Secured Creditor is the current assignee of the Security Deed to the Property. HGF Management Company LLC, acting on behalf of and, as necessary, in consultation with Secured Creditor (the current investor on the loan), is the entity with the full authority to negotiate, amend, and modify all terms of the loan. Please note that the Secured Creditor is not required by law to amend or modify the terms of the loan.
To the best knowledge and belief of the undersigned, the party/parties in possession of the Property is/are: JAMES DAVID HOWARD and/or tenant/tenants.
Said Property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable); (b) unpaid water or sewage bills that constitute a lien against the Property whether due and payable or not yet due and payable and which may not be of record; (c) the right of redemption of any taxing authority; (d) any matters which might be disclosed by an accurate survey and inspection of the Property; and (e) all matters of record superior to the Security Deed set out above, including, but not limited to, assessments, liens encumbrances, zoning ordinances, easements, restrictions, covenants, etc.
The sale will be conducted subject to: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
Pursuant to O.C.G.A. § 9-13-172.1, which allows for certain procedures regarding the rescission of judicial and nonjudicial sales in the State of Georgia, the Deed Under Power and other foreclosure documents may not be provided until final confirmation and audit of the status of the loan as provided in the preceding paragraph.
