NOTICE OF SALE UNDER POWER STATE OF GEORGIA MUSCOGEE COUNTY By virtue of a power of sale contained in a certain security deed from Mary Kay Nester to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for Bank 34, its successors and assigns and recorded in Deed Book 12320, Page 14, Muscogee County, Georgia records given to secure a note in the original amount of $60,000.00 with interest on the unpaid balance until paid, the following described property will be sold at public outcry to the highest bidder for cash at the courthouse door of MUSCOGEE COUNTY, Georgia, or at such place as has or may be lawfully designated as an alternative location within the legal hours of sale on the first Tuesday in June, 2026, to wit: June 02, 2026, the following described property: All that tract and parcel of land situate, lying and being in Columbus, Muscogee County, Georgia, being known and designated as the North Three-fourth of Lot Numbered Ten (10) and the South one-fourth of Lot Numbered Eleven (11), in Block Lettered "D", Waverly Terrace as said lots are shown upon a plat recorded in Deed Book 5, Folio 488, in the office of the Clerk of the Superior Court of Muscogee County, Georgia, the tract and parcel hereby conveyed being located within the following metes and bounds: Beginning at a point located on the westerly line of Beacon Avenue at a point 162.5 feet northerly as measured along the westerly line of Beacon Avenue, from the northwesterly corner of the intersection of Beacon Avenue and 29th Street, and from said point of beginning running thence westerly, parallel to the northerly line of 29th Street, a distance of 150 feet to a point located on the line dividing said Lot 10 from Lot 3 in said Block "D"; running thence northerly along the line dividing said Lots 10 and 11 from said Lot 3 and Lot 2 in said Block "D", a distance of 50 feet to a point; running thence easterly, parallel to the northerly line of 29th Street, a distance of 150 feet to a point located on the westerly line of Beacon Avenue; and running thence southerly, along the westerly line of Beacon Avenue, and running thence southerly along the westerly line of Beacon Avenue, a distance of 50 feet to the point of beginning. The above-described property is conveyed together with and/or subject to all valid and enforceable restrictive covenants, zoning ordinances and easements of record. Being real property commonly known as 2915 Beacon Avenue, Columbus, GA 31904. The debt secured by the above-referenced security deed has been declared due because of the default in the payment of said debt per the terms of the note and other possible defaults by the borrower or the successor thereto. The debt remaining in default, this sale will be made for the purpose of paying the debt and all expenses of this sale including attorney's fees (notice of intent to collect attorney's fees having been given). Said sale will be made subject to the following items which may affect the title to said property: All restrictive covenants, easements and rights-of-way appearing of record, if any; all zoning ordinances; matters which would be disclosed by an accurate survey or by an inspection of the property; all outstanding or unpaid bills and assessments for street improvements, curbing, garbage, water, sewage and public utilities which may be liens upon said property; and any outstanding taxes, assessments and other liens superior to the security deed being foreclosed hereby. To the best knowledge and belief of the undersigned, the above-described property is in the possession of the borrower and/or other persons with the consent and acquiescence of the borrower.
