NOTICE OF SALE UNDER POWER GEORGIA, MUSCOGEE COUNTY By virtue of power of sale in that certain Deed to Secure Debt, Assignment of Leases and Rents and Security Agreement dated January 3, 2024, from Da Hill State Group LLC, a Georgia limited liability company ("Borrower") to Argentic Real Estate Finance 2 LLC, a Delaware limited liability company ("Original Lender"), recorded January 26, 2024 at Deed Book 14324, page 175 in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, as affected by that certain Assignment and Assumption of Interest Under Deed to Secure Debt, Assignment of Leases and Rents, and Security Agreement dated January 3, 2024, from Original Lender to AREF 2 WH WF LLC, a Delaware limited liability company, recorded March 14, 2024 at Deed Book 14360, page 313, as affected by that certain Assignment of Deed to Secure Debt, Assignment of Leases and Rents and Security Agreement dated May 15, 2024 from AREF 2 WH WF LLC to Argentic Real Estate Finance 2 LLC, recorded August 1, 2024 at Deed Book 14475, page 343, and as affected by that certain Assignment of Deed to Secure Debt, Assignment of Leases and Rents and Security Agreement dated May 15, 2024 from Argentic Real Estate Finance 2 LLC to Computershare Trust Company, National Association, as Trustee, on behalf of the Registered Holders of BMO 2024-5C4 Mortgage Trust, Commercial Mortgage Pass-Through Certificates, Series 2024-5C4 and the Uncertificated Interest Owners, recorded August 1, 2024 at Deed Book 14476, page 5 in said Clerk's Office (collectively the "Security Deed"), the Security Deed having been given to secure the debt evidenced by, among other things, that certain Promissory Note dated January 3, 2024, with interest from the date thereof at the rate specified therein (together with any and all assignments, renewals, replacements, modifications, and extensions thereof, hereafter collectively referred to as the "Note"), the undersigned will sell at public outcry to the highest bidder for cash before the door of the County Courthouse in Columbus, Muscogee County, Georgia, on the first Tuesday in June, 2026 (June 2, 2026), between the legal hours of sale, all or parts of the property designated as Muscogee County Map Parcel Numbers 069 023 002 and 069 023 004 located at 3528 and 3546 Gentian Boulevard, Columbus, Georgia 31907, and more particularly described as follows (the "Land"): PARCEL A: All that tract or parcel of land situate, lying and being in Land Lot 28, 8th District, Columbus, Muscogee County, Georgia, and being more particularly described as follows: Commencing at a concrete monument located at the northwest terminus of the mitered corner formed by the intersection of the southerly right-of-way line of Gentian Boulevard with the westerly right-of-way line of Valley Road and run thence South 70 degrees 25 minutes 30 seconds West along the southerly right-of-way line of Gentian Boulevard a distance of 231.97 feet to an iron pin at the Point of Beginning; from said point of beginning thence run South 08 degrees 16 minutes 19 seconds East a distance of 195.13 feet to an iron pin; thence run South 00 degrees 48 minutes 00 seconds West a distance of 435.00 feet to an iron pin; thence run South 76 degrees 30 minutes 00 seconds West a distance of 149.97 feet to a pk nail; thence run North 01 degree 20 minutes 00 seconds East a distance of 418.67 feet to a pk nail; thence run North 07 degrees 37 minutes 18 seconds West a distance of 174.00 feet to a point on a storm inlet on the southerly right-of-way line of Gentian Boulevard; thence run North 70 degrees 25 minutes 30 seconds East along the southerly right-of-way line of Gentian Boulevard a distance of 11.40 feet to an iron pin; thence run North 19 degrees 58 minutes 00 seconds West along the southerly right-of-way line of Gentian Boulevard a distance of 22.00 feet to an iron pin; thence run North 70 degrees 25 minutes 30 seconds East a distance of 142.06 feet to an iron pin at the Point of Beginning. Containing 3.672 acres. Being the same property conveyed by Limited Warranty Deed dated January 3, 2024 from 3528 Gentian Boulevard Holdings LLC, a Maryland limited liability company, to Da Hill State Group LLC, a Georgia limited liability company, recorded January 26, 2024 at Deed Book 14324, page 169 in the Office of the Clerk of the Superior Court of Muscogee County, Georgia. And in conjunction with the sale of the above described Land, as provided under the laws of the State of Georgia, including Georgia Code sections 11-9-604 and 11-9-610, Lender will sell at public outcry to the highest bidder for cash before the door of the County Courthouse in Columbus, Muscogee County, Georgia, on the first Tuesday in June, 2026 (June 2, 2026), between the legal hours of sale, all or parts of the following property (together with the Land, hereafter referred to as the "Property"): all tangible personal property of Borrower located on the Land, including, without limitation, appurtenances, structures, improvements, furnishings, fixtures, and all other tangible personal property and fixtures, all subject to applicable restrictions to right of use under any license agreement (but in no event including cash, accounts, or general intangibles) as more particularly set out in UCC1 Financing Statement from Borrower to Argentic Real Estate Finance 2 LLC, recorded March 14, 2024 at Deed Book 14360, page 323, as subsequently assigned by UCC Amendments recorded at Deed Book 14361, page 105, Deed Book 14476, page 1, and at Deed Book 14486, page 207 (collectively, the "Fixture Filing"), and by UCC1 Financing Statement from Borrower to Argentic Real Estate Finance 2 LLC, filed January 26, 2024 as UCC Number 106-2024-000220 in the Georgia centralized UCC system through said Clerk's Office, and subsequently assigned by UCC Amendments as Instrument Numbers 106-2024-000230, 106-2024-001423, and 106-2024-001510 (collectively, the "Financing Statement"), the Fixture Filing and the Financing Statement collectively referred to as the Financing Statements. THIS SALE OF THE PROPERTY WILL BE MADE WITHOUT WARRANTY, EITHER EXPRESS OR IMPLIED, AS TO TITLE, CONDITION, MERCHANTABILITY, OR FITNESS FOR ANY USE OR PURPOSE WHATSOEVER. The Property will be sold as the property of Borrower. To the undersigned's best knowledge and information, Borrower is the party in possession of the Property. The following items, recorded in said Clerk's Office, may be adversely affected by the foreclosure sale: (1) Claim of Lien of HD Supply Facilities Maintenance, Ltd., dated August 21, 2025, recorded August 22, 2025 at Lien Book 928, page 455; (2) Materialman's and Mechanic's Claim of Lien of DAYCO Systems, LLC, dated October 17, 2025, recorded October 17, 2025 at Lien Book 930, page 309; (3) Claim of Lien of Carraway Group, Inc. dated September 27, 2025, recorded December 3, 2025 at Lien Book 931, page 440; and (4) Claim of Lien of The Sherwin-Williams Company dated December 10, 2025, recorded December 10, 2025 at Lien Book 932, page 128. The sale of the Property will be "as is" and "where is", subject to all zoning ordinances, matters that would be disclosed by an accurate survey or an inspection of the Land; any outstanding taxes; all outstanding governmental assessments, including unpaid real and personal property ad valorem taxes; all outstanding bills for public utilities that constitute liens upon the Property; all restrictive covenants, easements, right-of-way, assessments of record, and matters of record superior to the Security Deed and subject to any applicable license rights related thereto. The sale of the Property will be conducted subject to (i) confirmation that it is not prohibited by the United States Bankruptcy Code, and (ii) the provisions of O.C.G.A. section 9-13-172.1 that permit the rescission of judicial and non-judicial foreclosure sales in Georgia in certain circumstances. The undersigned will execute a deed to the purchaser as provided in the Security Deed. The indebtedness secured by the Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to repay the Note in full upon acceleration of the indebtedness upon the failure of Borrower to make payments when due. The debt remaining in default, this sale will be made for the purpose of paying the debt, including accrued interest, expenses of the sale, and attorney's fees, notice of intention to collect attorney's fees having been given in accordance with applicable law, as well as all other sums provided for under the Note and the Security Deed. The remaining proceeds, if any, shall be applied as provided by law.
