NOTICE OF POWER OF SALE CONTAINED IN SECURITY DEED
STATE OF GEORGIA
COUNTY OF MUSCOGEE
Under and by virtue of the power of sale contained in that certain Deeds to Secure Debt from VINSON COMPANY, LLC (hereinafter referred to as "Grantor") to SERVISFIRST BANK, an Alabama Banking Institution, dated May 20, 2022 and recorded in Deed Book 13851, Page 217 in the Superior Court of Muscogee County, Georgia records (hereinafter referred to as the "Security Deed"), ServisFirst Bank, the present holder of the Promissory Note and Security Deed defined herein, (hereinafter referred to as the "Secured Creditor") as attorney in fact for Grantor, will sell at public outcry to the highest and best bidder for cash between the legal hours of sale before the courthouse door of Muscogee County, Georgia on the first Tuesday in June, 2026, (June 2, 2026), the following described property (the "Property"), to-wit:
Begin at an iron pin located where the westernmost right-of-way line of Oneda Drive (80 foot right-of-way) intersects the northwesternmost right-of-way line of Mutec Drive (80 foot right-of-way) and run thence along said northwestern right-of-way line of Mutec Drive south 54 degrees 25 minutes 00 seconds west a distance of 333.53 feet to an iron pin located on said right-of-way line; run thence along said right-of-way line and following the arc of a curve to the left, said curve having a radius of 1,066.04 feet, an arc distance of 627.82 feet, said curve being subtended by a chord bearing south 37 degrees 32 minutes 42 seconds west a chord distance of 618.79 feet to an iron pin located on said right-of-way line; run thence north 32 degrees 08 minutes 46 seconds west a distance of 429.88 feet to an iron pin; run thence north 52 degrees 56 minutes 48 seconds west a distance of 180. 42 feet to an iron pin; run thence north 33 degrees 25 minutes 39 seconds west a distance of 288.15 feet to an Iron pin; run thence north 25 degrees 08 minutes 54 seconds east a distance of 389.75 feet to an iron pin; run thence south 72 degrees 49 minutes 12 seconds easy a distance of 321.90 feet to an iron pin; run thence north 82 degrees 55 minutes 04 seconds east a distance of 546.41 feet to an iron pin located on the westernmost right-of-way line of Oneda Drive; run thence along said right-of-way line and following the arc of a curve to the left, said curve having a radius of 523.65 feet, an arc distance of 151.88 feet, said curve being subtended by a chord having a bearing of south 18 degrees 24 minutes 44 seconds east a chord distance of 151.35 feet to an iron pin located on said right-of-way line; run thence along said right-of-way line south 26 degrees 43 minutes 13 seconds east a distance of 124.52 feet to an iron pin located on said right-of-way line; run thence along said right-of-way line and following the arc of a curve to the left, said curve having a radius of 685.17 feet, an arc distance of 105.99 feet, said curve being subtended by a chord having a bearing of south 31 degrees 09 minutes 06 seconds east a chord distance of 105.88 feet to an iron pin located on said right-of-way; run thence along said right-of-way line south 35 degrees 35 minutes 00 seconds east a distance of 10 feet to the point of beginning; said parcel containing 15.50 acres and being more particularly shown as Corporate Ridge, Lot 3 on that certain plat entitled "Survey of Lot 3, Corporate Ridge Industrial Park, Lying in Land Lot 57, 9th District Columbus, Muscogee County, Georgia" prepared by Jordan, Jones, & Goulding and dated February 18, 1991 being filed for record in Plat Book 115, Folio 87 in the Office of the Clerk of the Superior Court of Muscogee County, Georgia.
Said property has a current street address on 1 Remitco Way, Columbus, Georgia 31906.
Said Security Deed secures that certain promissory note dated May 20, 2022, made by Vinson Company, LLC in favor of ServisFirst Bank, in the original principal amount of One Million Three Hundred Thousand and 00/100 Dollars ($1,300,000.00) with interest thereon, together with any and all other indebtedness owed by Grantor to Secured Creditor
The indebtedness arising from the Promissory Note has been and is hereby declared due because of default under the terms of the Promissory Note. The indebtedness remaining in default, the sale will be made for the purpose of applying the proceeds thereof to the payment of the indebtedness secured by the Security Deed, accrued interest and expenses of the sale, and all other payments provided for under the Promissory Note and Security Deed, including attorney fees as provided in the Promissory Note and Security Deed, notice of intention to collect attorney fees having been given as provided by law; and the remainder, if any, shall be applied as provided by law.
The following information is being provided in accordance with OCGA § 44-14-162.2. SERVISFIRST BANK is the Secured Creditor under the Security Deed and loan being foreclosed. The following entity shall have full authority to negotiate, amend, and modify all terms of the above-described Security Deed and associated note on behalf of the Secured Creditor: Kemmer Law P.C.; 820 Broadway, Columbus, GA 31901; Telephone No.: (706) 322-2212, Attn: Foreclosures. OCGA § 44-14-162.2 states in pertinent part that, "nothing in this subsection shall be construed to require a secured creditor to negotiate, amend, or modify the terms of a mortgage instrument."
The sale will be conducted subject (1) to confirmation that the sale is not prohibited under the U.S. Bankruptcy Code, and (2) to final confirmation and audit of the status of the loan with the holder of said Security Deeds.
Said property will be sold subject to all liens, encumbrances, unpaid real estate ad valorem taxes and governmental assessments and to all prior restrictions, rights-of-way, and easements of record, if any, appearing of record prior to the date of the Security Deeds and those appearing after the date of the Security Deeds and consented to by the Secured Creditor.
To the best knowledge and belief of Secured Creditor, the equitable title to the Property is vested in Grantor.
