NOTICE OF SALE UNDER POWER IN SECURITY DEED

Under and by virtue of the Power of Sale contained in the Deed to Secure Debt, Security Agreement and Fixture Filing from HP Group 2018 LLC to Colony Bank dated May 24, 2023 as recorded in Deed Book 14145, Page 302, in the offices of the Clerk of the Superior Court of Muscogee County, Georgia as last assigned to 1916 Manchester LLC by Transfer and Assignment of Security Deed and Assignment of Rents to be recorded in the aforesaid records (as same may have been modified from time to time, collectively the "Security Deed"), the undersigned will sell at public outcry to the highest and best bidder for cash before the door of the Courthouse of Muscogee County, Georgia, during the legal hours of sale, on the first Tuesday in May, 2026 the following described real property, to wit:
ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN LAND LOT 53, 8TH DISTRICT, MUSCOGEE COUNTY, GEORGIA, AND BEING SHOWN ON THAT CERTAIN ALTA/NSPS SURVEY FOR HP GROUP 2018 LLC, MANCHESTER 2021 INC, COLONY BANK AND CHICAGO TITLE INSURANCE COMPANY, PREPARED BY ADAM AND LEE LAND SURVEYING BEARING THE SEAL AND CERTIFICATION OF JAMES A. JACOBS, G.R.L.S. NO. 2867, DATED DECEMBER 14, 2022, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS:

FROM THUS ESTABLISHED POINT OF BEGINNING AND LEAVING SAID RIGHT-OF-WAY SOUTH 01° 50' 37" WEST A DISTANCE OF 133.80 FEET TO A ½ INCH REBAR FOUND; THENCE NORTH 87° 20' 11" WEST A DISTANCE OF 199.97 FEET TO A ¾ INCH CRIMP TOP PIPE FOUND; THENCE NORTH 01° 49' 44"; EAST A DISTANCE OF 132.10 FEET TO A ½ INCH REBAR SET ON THE SOUTHERLY RIGHT-OF-WAY OF MANCHESTER EXPRESSWAY; THENCE ALONG SAID RIGHT-OF-WAY THE FOLLOWING COURSES AND DISTANCES: SOUTH 88° 18' 28" EAST A DISTANCE OF 2.50 FEET TO A CALCULATED POINT; THENCE SOUTH 02° 37' 06'' WEST A DISTANCE OF 9.04 FEET TO A 5/8 INCH REBAR FOUND WITH AN EMC CAP; THENCE SOUTH 87° 51' 03" EAST A DISTANCE OF 10.20 FEET TO A CALCULATED POINT; THENCE NORTH 01° 32' 34" EAST A DISTANCE OF 9.15 FEET TO A CALCULATED POINT; THENCE SOUTH 87° 49' 38" EAST A DISTANCE OF 57.46 FEET TO A CALCULATED POINT; THENCE SOUTH 87° 45' 44" EAST A DISTANCE OF 130.00 FEET TO THE TRUE POINT OR PLACE OF BEGINNING.
SAID TRACT OR PARCEL OF LAND CONTAINING 0.608 ACRES AS SHOWN ON SURVEY DESCRIBED ABOVE AND BEING KNOWN AS 1916 MANCHESTER EXPRESSWAY, COLUMBUS, GEORGIA, ACCORDING TO THE PRESENT SYSTEM OF NUMBERING IN MUSCOGEE COUNTY, GEORGIA.
PROPERTY BEING MORE COMMONLY KNOWN AS: 1916 MANCHESTER EXPRESSWAY, COLUMBUS, MUSCOGEE COUNTY, GEORGIA 31904 [TAX PARCEL ID # 034 026 003]
In addition, under and by virtue of the power of sale contained in the Security Deed, the undersigned will also sell at public outcry to the highest bidder for cash before the door of the Courthouse of Muscogee County, Georgia, immediately following the sale of the above-described real property, the following described personal property owned by HP GROUP 2018 LLC, or its successors-in-title and secured by the Security Deed, to wit:
All personal property described in and subject to the Security Deed, which is hereby incorporated by this reference.
Less and except any fixtures subject to the security interest on the above-described real property.
The debt secured by the Security Deed is evidenced by a Promissory Note, dated May 24, 2023 from HP GROUP 2018 LLC to Colony Bank, in the original principal amount of $2,044,700.00 (as same may have been further modified, renewed or amended, collectively the "Note"); plus interest from date on the unpaid balance until paid, and other indebtedness.
Default has occurred and continues under the terms of the Note and Security Deed by reason of, among other possible events of default, the nonpayment when due of the indebtedness evidenced by the Note and secured by the Security Deed and the failure to comply with the terms and conditions of the Note and Security Deed. By reason of this default, the Security Deed has been declared foreclosable according to its terms.
The above-described real property will be sold to the highest and best bidder for cash as the property of HP GROUP 2018 LLC, the proceeds to be applied to the payment of said indebtedness, attorneys' fees, and the lawful expenses of said sale, all as provided in the Note and Security Deed. The sale shall be subject to the following: all outstanding ad valorem taxes and/or assessments, if any; possible redemptive rights of the Internal Revenue Service, if any; and all prior assessments, easements, restrictions or matters of record.
To the best of the undersigned's knowledge and belief, the real property is presently owned by HP GROUP 2018 LLC.
To the best of the undersigned's knowledge and belief, the party in possession of the real property is HP GROUP 2018 LLC, and tenants holding under it.
All personal property will be sold in one lot to the highest and best bidder for cash as the property of HP GROUP 2018 LLC, or its successors-in-title, on an "as is, where is" basis and without representation, warranty or recourse, express or implied, of the undersigned, and subject to all matters of record affecting said personal property, the proceeds to be applied to the payment of said indebtedness, attorneys' fees and the lawful expenses of said sale, all as provided in the Security Deed.
