Foreclosure NOTICE OF SALE UNDER POWER COUNTY OF MUSCOGEE STATE OF GEORGIA Under and by virtue of the power of sale contained in that certain Deed to Secure Debt, Assignment of Rents and Security Agreement dated December 18, 2025 from FF Asset Fund 1, LLC ("Grantor") granting Matthew Hagerty ("Lender") a security interest in that certain real property located at 1339 16th Street, Columbus, Muscogee County, Georgia 31901, as more particularly described therein (the "Property"), recorded on March 25, 2026 at Deed Book 14890, Page 481, Muscogee County, Georgia records (the "Security Deed"), which secures, inter alia, the amounts owed on that certain Promissory Note from Freaky Fast Home Buyers and Investors, LLC to Lender dated August 10, 2023, as modified by that certain Cure Agreement dated January 26, 2024, that certain Second Cure Agreement dated April 26, 2024, that certain Amendment to Second Cure Agreement and Related Promissory Note and Guaranty dated June 26, 2024, and that certain Forbearance Agreement between, inter alia, Grantor and Lender dated October 8, 2025, as subsequently amended (the "Forbearance Agreement"), with a maturity date of January 31, 2027, and an original loan amount of $690,107.32, there will be sold at public outcry by Lender as attorney-in-fact of Grantor to the highest bidder for cash between the legal hours for sale before the Courthouse door in Muscogee County, Georgia, on May 5, 2026, the following described land, improvements and appurtenances (hereinafter collectively referred to as the "Premises") to wit: All that tract or parcel of land situate, lying and being in the State of Georgia, County of Muscogee and City of Columbus, and being known and. designated as the EAST ONE-HALF of Lot Numbered TEN (10), and the WEST ONE THIRD of Lot Numbered ELEVEN (11), of BARNETTE PLACE SUBDIVISON, as shown by a map or plat entitled New Map of Barnett Place, resurveyed by Josiah Flournoy in the year 1915, and recorded in Deed Book 23, folio 24 (a redrawing of said map being recorded in Plat Book 33, folio 104.) in the office of the Clerk of the Superior Court of Muscogee County, Georgia, said tract or parcel of land hereby conveyed being more particularly described within the following metes and bounds, to-wit: Beginning at an iron stake located on the northern line of 16th (formerly Barnett) Street at an iron stake located 311.03 feet westerly, as measured along the northern line of 16th Avenue, from another iron stake located at the intersection of the northwestern corner of 16th Street and 14th Avenue, and from said beginning point running westerly and along the northern line of 16th Street 41.67 feet to another iron stake; thence running northerly, through the center of said Lot #10, a distance of 143.1 feet to another iron stake located on the northern line of said Lot #10; thence running easterly, along the northern lines of said Lots #10 and 11, a distance of 41.67 feet to another iron stake; and thence running southerly a distance of 144.2 feet to the beginning point. Located thereon is house #1339 - 16th Street, according to the present numbering of houses in Columbus, Georgia. Said tract or parcel of land is conveyed together with and subject to a joint driveway easement for ingress and egress purposes, said driveway being approximately 7 feet in width and. extending back northerly from the northern line of 16th Avenue a distance of 52.2 feet, part of said driveway easement being off of the eastern side of the aforedescribed property, and the other part thereof being off of the property lying immediately east of and adjacent thereto. This is the same easement that is described in the deed from Mrs. W. C. Davidson to C. L. Elrod, dated June 25, 1936, and recorded in Deed, Book 130, folio 280, in the office of the aforementioned Clerk. The abovedescribed tract or parcel of land, together with said easement, is the same that Mrs. Lillian Noyes conveyed to Cinthia A. Taylor by deed dated March 8, 1945, and recorded in Deed Book 210, folio 350; that Cinthia A. Taylor conveyed to Frank P. Taylor by deed dated May 28, 1975, and recorded in Deed Book 1548, folio 249; and that is shown on a survey entitled Survey of the property of Cinthia A. Taylor, West 1/3 Lot 11, & East 1/2 Lot 10 & Easement, Barnett Place, Columbus, Muscogee County, Georgia, made by Siegel Engineering Company, dated November 9, 1949, and attached to this deed and made a part thereof; said deed book references being as to those in the office of the Clerk of the Superior Court of Muscogee County, Georgia. Said property is conveyed subject to all valid and enforceable easement and restrictions of record and to applicable zoning ordinances and regulations promulgated pursuant thereto for so long as same shall remain of binding force and effect. Tax Parcel ID No. 027 015 022 The indebtedness evidenced by the Forbearance Agreement and underlying debt instruments is due and payable and remains unpaid. The Security Deed therefore has become and is now foreclosable according to its terms. Accordingly, the Premises will be sold at public outcry pursuant to the terms of the power of sale provided in the Security Deed. The Grantor has been notified of the same, pursuant to O.C.G.A. § 44-14-162.2. The Premises will be sold on an "as is, where is" basis without recourse against Lender or its auctioneer or other agents and without representation or warranty of any kind or nature whatsoever by Lender or its auctioneer or other agents with respect thereto. All persons attending the sale will be given an opportunity to bid on a competitive basis. Lender may offer the Premises for sale, may adjourn and withdraw the sale and recommence the sale in its discretion. Lender reserves the right, in its discretion, to reject any and all bids that do not meet its minimum reserve price. The proceeds of the sale are to be applied first to the expenses of the sale and all proceedings in connection therewith, including attorneys' fees (notice of intention to collect attorneys' fees having been given), then to the payment of all sums secured by the Security Deed, and the remainder, if any, will be paid to the person or persons legally entitled thereto, all as provided in the Forbearance Agreement and Security Deed. The Premises shall be sold as the property of Grantor, subject to all restrictions, easements, encumbrances and other matters of record that are prior to the Security Deed and to which the Security Deed is subject, and to any unpaid city, county and state ad valorem taxes or assessments relating to the Premises. To the best of the undersigned's knowledge and belief, the owner of the Premises is FF Asset Fund 1, LLC and the party or parties in possession of the Premises are FF Asset Fund 1, LLC and/or tenants of FF Asset Fund 1, LLC.
