NOTICE OF SALE UNDER POWER, MUSCOGEE COUNTY
Pursuant to the Power of Sale contained in a Security Deed given by Stanley Martin Cope and Jessica Cope to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for Ameris Bank, its successors and assigns dated 6/29/2020 and recorded in Deed Book 13020 Page 347 Muscogee County, Georgia records; as last transferred to or acquired by Truist Bank, conveying the after-described property to secure a Note in the original principal amount of $416,500.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Muscogee County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on May 5, 2026 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN COLUMBUS, MUSCOGEE COUNTY, GEORGIA, BEING PART OF LAND LOT 256 OF THE 19TH DISTRICT OF SAID STATE AND COUNTY, BEING KNOWN AND DESIGNATED AS ALL OF PARCEL 24, STONEWOOD, AS SAID LOT IS MORE PARTICULARLY IDENTIFIED ON THAT CERTAIN PLAT MADE BY HUGH RILEY, REGISTERED LAND SURVEYOR, GEORGIA 1285, RECORDED IN PLAT BOOK 101, FOLIO 1, OF THE RECORDS IN THE OFFICE OF THE CLERK OF SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGIA, TO WHICH PLAT REFERENCE IS MADE FOR THE SPECIFIC DIMENSIONS AND LOCATION OF SAID PARCEL, TOGETHER WITH AN EASEMENT IN THE "ASSOCIATION PROPERTIES" AND "COMMON AREAS", AND ANY ADDITIONS THERETO AS PER THE DECLARATION OF COVENANTS, CONDITIONS AND RESTRICTIONS FOR STONEWOOD, RECORDED IN SAID CLERK'S OFFICE IN DEED BOOK 2663, PAGE 67, AS AMENDED BY AMENDMENT RECORDED IN SAID CLERK'S OFFICE IN DEED BOOK 2978, PAGE 53, AND BY AMENDMENT RECORDED IN SAID CLERK'S OFFICE IN DEED BOOK 5863, PAGE 270, REFERENCE TO EACH OF WHICH IS HEREBY MADE, AND ALL OTHER AMENDMENTS THERETO, SUBJECT TO THE ITEMS HEREAFTER ENUMERATED. The foregoing Parcel, together with the above said easements and appurtenances, is conveyed subject to all valid and enforceable easements and restrictions of record, and to all applicable zoning ordinances and regulations promulgated pursuant thereto, for so long as same shall remain of binding force and effect, including without limitation: (i) the terms, covenants, conditions and restrictions of the Declaration for Stonewood, recorded in Deed Book 2663, Page 67, aforesaid records, and all amendments thereto; and (ii) the rights of upper and lower riparian owners, and rights of access, if any, to the cemeteries as may be located in the surrounding area. Said property is presently assigned street address of 8900 River Road, Columbus, Georgia 31904 according to the present system of assigning street addresses in Muscogee County, Georgia. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property is commonly known as 8900 River Rd, Columbus, GA 31904 together with all fixtures and personal property attached to and constituting a part of said property, if any. To the best knowledge and belief of the undersigned, the party (or parties) in possession of the subject property is (are): Stanley Martin Cope and Jessica Cope or tenant or tenants. Said property will be sold subject to: (a) any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), (b) unpaid water or sewage bills that constitute a lien against the property whether due and payable or not yet due and payable and which may not be of record, (c) the right of redemption of any taxing authority, (d) any matters which might be disclosed by an accurate survey and inspection of the property, and (e) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
