NOTICE OF SALE UNDER POWER STATE OF GEORGIA, COUNTY OF MUSCOGEE By virtue of a Power of Sale contained in that certain Security Deed from Empson Investments LLC to Dominion Financial Services, LLC, dated April 14, 2023 and recorded on April 19, 2023 in Deed Book 14116, Page 222, in the Office of the Clerk of Superior Court of Muscogee County, Georgia, said Security Deed having been given to secure a Note of even date, in the original principal amount of One Hundred Thousand One Hundred and 00/100 dollars ($100,100.00) with interest thereon as provided therein, as last transferred to Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as trustee for Ibis Holdings A Trust, recorded in Deed Book 14616, Page 157, aforesaid records, will be sold at public outcry to the highest bidder for cash before the courthouse door of Muscogee County, Georgia, or at such place as has or may be lawfully designated as an alternative location, within the legal hours of sale on the first Tuesday in March, 2026, all property described in said Security Deed including but not limited to the following described property:z ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN LAND LOT 29 OF THE 8TH DISTRICT OF MUSCOGEE COUNTY, GEORGIA, AND BEING SHOWN AND DESIGNATED AS "PARCEL 2" ON THAT CERTAIN MAP OR PLAT THEREOF ENTITLED "PROPERTY OF WILLIAM A. ROMEO, REPLAT OF PART OF LOT 3, ALMARK SUBDIVISION, AND PART OF LOT 1, BLOCK "J" EDGEWOOD, COLUMBUS, MUSCOGEE COUNTY, GEORGIA, DATED NOVEMBER 21, 1967, PREPARED BY G. V. CARR AND CO. AND RECORDED IN PLAT BOOK 42, FOLIO 47 IN THE OFFICE OF THE CLERK OF SUPERIOR COURT, AND BEING MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE SOUTHEAST CORNER OF THE INTERSECTION OF UNIVERSITY AVENUE (FORMERLY CODY ROAD) AND MOTE ROAD, THENCE RUNNING NORTH 88° 30' EAST, A DISTANCE OF 327.62 FEET TO AN IRON PIN; THENCE SOUTH 03° 09' EAST, 200 FEET TO THE POINT OF BEGINNING, BEING THE NORTHWEST CORNER OF SAID PARCEL 2 AND FROM SAID POINT OF BEGINNING RUNNING THENCE SOUTH 03° 09' EAST, A DISTANCE OF 97.04 FEET (PREVIOUSLY ERRONEOUSLY STATED AS 116.58 FEET) TO AN IRON PIN LOCATED ON THE NORTHERLY MARGIN OF OAK CIRCLE; RUNNING THENCE SOUTHEASTERLY ALONG THE NORTHEASTERN MARGIN OF OAK CIRCLE, A DISTANCE OF 138.25 FEET TO AN IRON PIN; RUNNING THENCE NORTH 03° 09' WEST, A DISTANCE OF 196.29 FEET (PREVIOUSLY ERRONEOUSLY STATED AS 315.08 FEET) TO AN IRON PIN; RUNNING THENCE SOUTH 88° 30' WEST, A DISTANCE OF 90 FEET TO THE POINT OF BEGINNING. LOCATED THEREON IS DWELLING NUMBER 3124 OAK CIRCLE ACCORDING TO THE PRESENT SYSTEM OF NUMBERING DWELLINGS IN COLUMBUS, GEORGIA. SAID PROPERTY IS THE SAME PROPERTY CONVEYED BY THAT CERTAIN DEED FROM WILLIAM A. ROMEO TO WARREN H. MORRIS AND DOCIA F. MORRIS, DATED MARCH 20, 1968 AND RECORDED IN DEED BOOK 1165, PAGE 497, AFORESAID RECORDS. PARCEL ID NUMBER: 085 005 004. SUBJECT TO ANY EASEMENTS OR RESTRICTIONS OF RECORD. Said property may more commonly be known as 3124 Oak Circle, Columbus, GA 31907. The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, non-payment of the monthly installments on said loan. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, including attorney's fees (notice of intent to collect attorney's fees having been given).z The individual or entity that has full authority to negotiate, amend and modify all terms of the loan is Wilmington Savings Fund Society, FSB, not in its individual capacity but solely as trustee for Ibis Holdings A Trust, 75 Beattie Place, Greenville, SC 29601, 1-800-365-7107. Said property will be sold on an "as-is" basis without any representation, warranty or recourse against the above-named or the undersigned. The sale will also be subject to the following items which may affect the title: a) zoning ordinances; b) matters which would be disclosed by an accurate survey or by an inspection of the property; c) any outstanding ad valorem taxes, including taxes, which constitute liens upon said property whether or not now due and payable; d) special assessments; e) the right of redemption of any taxing authority; f) all outstanding bills for public utilities which constitute liens upon said property; g) all restrictive covenants, easements, rights-of-way and any other matters of record superior to said Security Deed. To the best of the knowledge and belief of the undersigned, the owners and party in possession of the property are _ Empson Investments LLC and or tenant(s). The sale will be conducted subject to 1) confirmation that the sale is not prohibited under the U.S. Bankruptcy code and 2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
