ALL PERSONS, KNOWN OR UNKNOWN, WHO CLAIM, OR MIGHT CLAIM ADVERSELY TO PETITIONER'S TITLE TO ALL THAT TRACT OR PARCEL OF LAND SITUATE, LYING AND BEING IN COLUMBUS, MUSCOGEE COUNTY, GEORGIA, BEING KNOWN AND DESIGNATED AS PART OF CITY LOT NUMBERED THREE HUNDRED FIFTY-FOUR (354), AND BEING KNOWN AND DESIGNATED AS PARCEL 100, CONTAINING 0.2217 ACRES, OF THE REPLAT OF CITY LOT 354, AS SAID PARCEL 100 IS SHOWN ON THAT CERTAIN MAP OR PLAT ENTITLED "REPLAT OF CITY LOT 354, COLUMBUS, MUSCOGEE COUNTY, GEORGIA" DATED SEPTEMBER 11, 1995, PREPARED BY HOBBS, SMITH & ASSOCIATES, INC., CIVIL ENGINEERS, AND RECORDED IN PLAT BOOK 131, PAGE 32, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGIA; SAID PLAT BEING INCORPORATED HEREIN BY REFERENCE THERETO FOR A MORE PARTICULAR DESCRIPTION OF THE PROPERTY CONVEYED HEREIN.
SAID PARCEL IS CONVEYED SUBJECT TO THAT CERTAIN FAÇADE EASEMENT TO HISTORIC COLUMBUS FOUNDATION, DATED FEBRUARY 20, 1995, AND RECORDED IN DEED BOOK 4200, FOLIO 45, AFORESAID CLERK'S OFFICE.
SAID PARCEL IS FURTHER CONVEYED SUBJECT TO THAT CERTAIN EASEMENT FOR PEDESTRIAN TRAFFIC ONLY, INGRESS AND EGRESS SERVICING THE DWELLING ON PARCEL 101 AS SAID PARCEL 101 IS SHOWN IN SAID PLAT BOOK131,PAGE 32, AND IS MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE POINT WHERE THE NORTHWEST CORNER OF PARCEL 100 INTERSECTS WITH SECOND AVENUE; THENCE RUNNING N88°33'00"E, A DISTANCE OF 103.90 FEET TO A POINT AND THE POINT OF BEGINNING OF THE EASEMENT CONVEYED HEREIN; THENCE CONTINUING N88°33'00"E, A DISTANCE OF 20.00 FEET TO AN IRON PIN; THENCE S01°58'00"E, A DISTANCE OF 24.10 FEET TO A POINT; THENCE S88°33'00"W, A DISTANCE OF 20.0 FEET TO A POINT; THENCE N01°58'00"W, 20.00 FEET TO THE POINT OF BEGINNING.
ALSO: THIS CONVEYANCE INCLUDES AN ENCROACHMENT EASEMENT ALONG WITH ACCESS TO AND ON SAID ENCROACHMENT EASEMENT FOR PURPOSES OF INGRESS AND EGRESS TO THE DWELLING CONVEYED HEREIN. GRANTOR AGREES THAT ACCESS TO SAID ENCROACHMENT FOR PURPOSES OF REPAIRS TO THE DWELLING OR WOOD DECK WILL NOT BE UNREASONABLY DENIED FOR ANY NECESSARY REPAIRS TO THE DWELLING OR WOODDECK.SAID ENCROACHMENT EASEMENT ON THE ADJACENT PROPERTY OF THE GRANTOR FOR THE PURPOSES OF AN EXISTING WOOD DECK, IS DESCRIBEDAS FOLLOWS:COMMENCING AT THE POINT WHERE THE NORTHWEST CORNER OF PARCEL 100 INTERSECTS WITH SECOND AVENUE; THENCE RUNNING N88°33'00"E, A DISTANCE OF 63.9 FEET TO A POINT; THENCE N01°58'00"W, A DISTANCE OF 5.0 FEET TO A POINT; THENCE N88°33'00"E, A DISTANCE OF 22.0 FEET TO A POINT; THENCE S01°58'00"E, 3.5 FEET TO A POINT; THENCE N88°33'00"E, A DISTANCE OF 18.0 FEET TO A POINT, THENCE S01°58'00"E, 1.5 FEET TO A POINT, THENCE S88°33'00"W DISTANCE OF 44.0 FEET TO THE POINT OF BEGINNING. THIS CONVEYANCE IS STRICTLY FOR PURPOSES OF THE EXISTING WOOD DECK ATTACHED TO THE DWELLING AT PARCEL 100, AND IF SAID DECK CEASES TO EXIST FOR A PERIOD EXCEEDING THIRTY (30) DAYS, THIS EASEMENT WILL BE VOIDED; COMPASSSIONATE SERVICE CHARITIES, INC.; DANIEL M. VAN GASKEN AS TRUSTEE AND FIDUCIARY OF 14TH-F REAL ESTATE HOLDING TRUST; 14TH-F REAL ESTATE HOLDING TRUST; AND LARRY W. BUSSEY,
