NOTICE OF SALE UNDER POWER
Pursuant to the power of sale contained in the Security Deed executed by ZEPHANIAH BAKER to NEW CENTURY MORTGAGE CORPORATION in the original principal amount of $101,250.00 dated May 30, 2003, and recorded in Deed Book 6880, Page 312, Muscogee County records, said Security Deed being last transferred to U.S. BANK TRUST NATIONAL ASSOCIATION NOT IN ITS INDIVIDUAL CAPACITY BUT SOLELY AS OWNER TRUSTEE FOR RCF 2 ACQUISITION TRUST in Deed Book 10046, Page 347, Muscogee County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on 2/3/2026, the property in said Security Deed and described as follows:
ALL THAT LOT, TRACT AND PARCEL OF LAND SITUATE, LYING AND BEING IN COLUMBUS, MUSCOGEE COUNTY, GEORGIA, BEING KNOWN AND DESIGNATED AS ALL OF LOT NUMBERED EIGHTEEN (18), IN BLOCK LETTERED "B", LINDSAY CREEK PARK, AS SAID LOT IS SHOWN UPON A MAP OR PLAT OF SAID SUBDIVISION DATED JUNE 25, 1954, MADE BY LON E. WILLIAMSON, CIVIL ENGINEER, AND RECORDED IN PLAT BOOK 12, FOLIO 4, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGIA, TO WHICH REFERENCE IS MADE FOR THE PARTICULAR LOCATION AND DIMENSIONS OF SAID LOT, AND HAVING LOCATED THEREON HOUSE NUMBERED 1091 BOLTON COURT, ACCORDING TO THE PRESENT SYSTEM OF NUMBERING HOUSES IN COLUMBUS, GEORGIA; AND BEING THE SAME PROPERTY THAT COLUMBUS ENTERPRISES, INC., CONVEYED TO CHARLIE R. HATHAWAY AND MARY MCGARR HATHAWAY BY DEED DATED JULY 25, 1955, AND RECORDED IN DEED BOOK 531, FOLIO 65 IN THE OFFICE OF THE AFORESAID CLERK; SUBJECT TO ALL VALID AND ENFORCEABLE RESTRICTIVE COVENANTS AND EASEMENTS OF RECORD APPLICABLE THERETO.
Said property being known as: 1091 BOLTON CT, COLUMBUS, GA 31906
To the best of the undersigned's knowledge, the party or parties in possession of said property is/are ZEPHANIAH BAKER or tenant(s).
The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees (notice of intent to collect attorney's fees having been given).
Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above.
Said sale will be conducted subject to the following: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
