Under and by virtue of the Power of Sale contained in a Deed to Secure Debt and Security Agreement given by WH FX Properties, LLC to Mid Atlantic Senior Secured Income Fund, LLC, dated January 13, 2023, filed January 19, 2023, and recorded at Deed Book 14050, Page 342, Muscogee County, GA records, conveying the after-described property to secure a Promissory Note in the original principal amount of One Hundred Twenty-Five Thousand AND 00/100 Dollars ($125,000.00), with interest thereon as set forth therein; there will be sold at public outcry to the highest bidder for cash before the Courthouse door of MUSCOGEE COUNTY, Georgia, within the legal hours of sale on the first Tuesday in January, 2026, the following described Property: ALL THAT TRACT OR PARCEL OF LAND LYING AND BEING IN MUSCOGEE COUNTY, GEORGIA, CONTAINING 0.31 ACRE, MORE OR LESS, BEING LOT 8, BLOCK B, EAST LAKES SUBDIVISION, SECTION ONE, AS PER PLAT RECORDED AT PLAT BOOK 46, PAGE 105 "A" AND "B", MUSCOGEE COUNTY, GEORGIA, WHICH PLAT IS INCORPORATED HEREIN AND MADE A PART HEREOF. Said property is known as 5813 Hunter Road, Columbus, GA 31907, together with all fixtures and personal property attached to and constituting a part of said property, if any. The debt secured by said Deed to Secure Debt and Security Agreement has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Promissory Note and Deed to Secure Debt and Security Agreement. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale as provided in said Deed to Secure Debt and Security Agreement and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to any outstanding ad valorem taxes (including taxes which are a lien, but not yet due and payable), any matters which might be disclosed by an accurate survey and inspection of the property, any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Deed to Secure Debt and Security Agreement first set out above.
