SUMMONS To all owners and interest holders of Defendant Property In Rem: You are hereby summoned and required to file with the Clerk of this Court and serve upon Plaintiff's attorney, Cynthia McDonald, Assistant District Attorney, Chattahoochee Judicial Circuit, Office of the District Attorney, 100 East Tenth Street - 3rd Floor, Columbus, GA 31902-1340, an answer to the VERIFIED COMPLAINT FOR FORFEITURE, which is herewith served upon you, within thirty (30) days after personal service, if you wish to be heard by the Court. If you fail to do so, judgment by default will be taken against you for the relief demanded in the VERIFIED COMPLAINT FOR FORFEITURE. VERIFIED COMPLAINT FOR FORFEITURE NOW COMES, THE STATE OF GEORGIA, by and through the Office of the District Attorney for the Chattahoochee Judicial Circuit, and files this Complaint for Forfeiture pursuant to O.C.G.A. § 16-5-46 and § 9-16-12, and shows the Court as follows: 1. The property sought to be forfeited is described in the above-styled caption and is incorporated by reference thereto (hereinafter "defendant property"). 2. Defendant Property was lawfully seized by Inv. Patrice Watts, Muscogee County Sheriff's Office, in Muscogee County, Georgia, on April 27, 2025. 3. Defendant Property is presently in the custody of Muscogee County Sheriff's Office, which is located in Muscogee County, and will remain in the county during the pendency of this action. Pursuant to O.C.G.A. § 9-16-4, the property is subject to the jurisdiction of this Court and venue is proper in this Court. 4. On April 27, 2025, Muscogee County Sheriff's Office initiated a stop at 3315 Macon Road, Columbus, Georgia in the McDonald's parking lot on Defendant. 5. The Defendant, Jungmok Shin, was subsequently arrested for the violation of O.C.G.A. § 16-12-100.2, Computer or Electronic Pornography, in that, Defendant did unlawfully use an online messaging service to contact a person he believed was a child under 16 years of age, with the intent to satisfy the sexual desire of himself. 6. As a result of the illegal activity, the above referenced vehicle was seized. 7. The defendant property is contraband and subject to forfeiture to the State of Georgia pursuant to the provisions of O.C.G.A §§16-13-49(b) and 9-16-12, in that the defendant property was directly or indirectly used or intended for use to facilitate the offense. 8. The names and addresses of all potential owners and interest holders of Defendant Property are as follows: Jungmok Shin, 2700 College Drive, Apt. 909, Phenix City, AL 36869. WHEREFORE, the State prays that: 1. The Court enforce the forfeiture with all due process; and, 2. All known Claimants listed above be personally served with a copy of this VERIFIED COMPLAINT FOR FORFEITURE, along with the SUMMONS and all other accompanying documents; and, 3. The Court issue an order directing the custodian in possession of Defendant Property In Rem to seize it and hold it until further order of the Court; and, 4. The Court enter a final judgment of forfeiture in favor of the State declaring Defendant Property In Rem forfeited to the State; and, 5. The State have such other and further relief as is just and proper.
