NOTICE OF SALE UNDER POWER STATE OF GEORGIA COUNTY OF MUSCOGEE Pursuant to the power of sale contained in the Security Deed executed by JODIE ALEXANDRIA WARD to MORTGAGE ELECTRONIC REGISTRATION SYSTEMS, INC., AS GRANTEE, AS NOMINEE FOR CMG MORTGAGE, INC. DBA CMG HOME LOANS, ITS SUCCESSORS AND ASSIGNS in the original principal amount of $184,411.00 dated October 16, 2024, and recorded in Deed Book 14548, Page 112, Muscogee County records, said Security Deed being last transferred to CMG MORTGAGE, INC. in Deed Book 14638, Page 293, Muscogee County records, the undersigned will sell at public outcry to the highest bidder for cash, before the Courthouse door in said County, or at such other place as lawfully designated, within the legal hours of sale, on 01/06/2026, the property in said Security Deed and described as follows: ALL THAT TRACT AND PARCEL OF LAND, SITUATE, LYING AND BEING IN THE STATE OF GEORGIA, COUNTY OF MUSCOGEE AND CITY OF COLUMBUS, AND BEING KNOWN AND DESIGNATED AS PARTS OF LOTS NUMBERED FOUR (4) AND FIVE (5), IN BLOCK LETTERED "E", OF ROSEMONT HEIGHTS SUBDIVISION, AS SHOWN BY A MAP OR PLAT OF PART OF SAID BLOCK "E" OF SAID SUBDIVISION, DATED JULY 16, 1954, MADE BY SIEGEL ENGINEERING COMPANY, AND RECORDED IN PLAT BOOK 11, PAGE 58, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGIA, SAID TRACT AND PARCEL OF LAND BEING MORE PARTICULARLY DESCRIBED WITHIN THE FOLLOWING METES AND BOUNDS, TO-WIT: BEGINNING AT AN IRON STAKE SITUATED ON THE EASTERN CURVED LINE ACACIA DRIVE, AT THE SOUTHWESTERN CORNER OF SAID LOT #5, IN BLOCK "E", AND FROM SAID BEGINNING IRON RUNNING NORTHERLY, ALONG THE EASTERN LINE OF ACACIA DRIVE, 73.13 FEET TO ANOTHER IRON STAKE LOCATED 2 FEET SOUTHERLY, AS MEASURED ALONG SAID EASTERN LINE OF ACACIA DRIVE, FROM THE NORTHWESTERN CORNER OF SAID LOT #5; AND THENCE RUNNING NORTH 79 DEGREES 30 MINUTES EAST 151.93 FEET TO ANOTHER IRON STAKE LOCATED ON THE NORTHEASTERN OR REAR LINE OF SAID LOT #4 THENCE RUNNING SOUTH 11 DEGREES 38 MINUTES EAST, ALONG THE REAR LINES OF SAID LOTS #4 AND #5 OF SAID BLOCK "E", 106.2 FEET TO ANOTHER IRON STAKE LOCATED AT THE SOUTHEASTERN CORNER OF SAID LOT #5 AND THENCE RUNNING WESTERLY ALONG THE LINE DIVIDING SAID LOT #5 FROM LOT #6 OF SAID BLOCK "E", 170 FEET TO THE BEGINNING IRON. SAID TRACT AND PARCEL OF LAND HEREBY CONVEYED IS SHOWN ON A MAP OR PLAT ENTITLED "PART OF LOTS 4 AND 5, BLOCK E, ROSEMONT HEIGHTS, LYING IN LAND LOT 48, 8TH DISTRICT, MUSCOGEE COUNTY GEORGIA", DATED SEPTEMBER 12, 1957, AND RECORDED IN PLAT BOOK 18, PAGE 103, IN THE OFFICE OF THE CLERK OF THE SUPERIOR COURT OF MUSCOGEE COUNTY, GEORGIA. Said property being known as: 4322 ACACIA DRIVE, COLUMBUS, GA 31904 To the best of the undersigned's knowledge, the party or parties in possession of said property is/are JODIE ALEXANDRIA WARD or tenant(s). The debt secured by said Security Deed has been and is hereby declared due and payable because of, among other possible events of default, failure to pay the indebtedness as provided for in the Note and said Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of sale, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property will be sold subject to the following: (1) any outstanding ad valorem taxes (including taxes which are a lien, whether or not yet due and payable); (2) the right of redemption of any taxing authority; (3) any matters which might be disclosed by an accurate survey and inspection of the property; and (4) any assessments, liens, encumbrances, zoning ordinances, restrictions, covenants, and matters of record superior to the Security Deed first set out above. Said sale will be conducted subject to the following: (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
