NOTICE OF SALE UNDER POWER, MUSCOGEE COUNTY
Pursuant to the Power of Sale contained in a Security Deed given by Joseph E Parker to Mortgage Electronic Registration Systems, Inc., as grantee, as nominee for Ownit Mortgage Solutions, its successors and assigns. dated 12/7/2005 and recorded in Deed Book 8215 Page 272 Muscogee County, Georgia records; as last transferred to or acquired by Wells Fargo Bank, National Association, as Trustee for Ownit Mortgage Loan Trust, Mortgage Loan Asset-Backed Certificates, Series 2006-2, conveying the after-described property to secure a Note in the original principal amount of $58,000.00, with interest at the rate specified therein, there will be sold by the undersigned at public outcry to the highest bidder for cash before the Courthouse door of Muscogee County, Georgia (or such other area as designated by Order of the Superior Court of said county), within the legal hours of sale on January 6, 2026 (being the first Tuesday of said month unless said date falls on a Federal Holiday, in which case being the first Wednesday of said month), the following described property: All that tract or parcel of land lying and being in Land Lot 15, of the 7th District, in the City of Columbus, of Muscogee County, Georgia, and being Part of Lot 7, Block "F", of Esquiline Hills Subdivision, as per Map or Plat thereof being recorded in Plat Book 06, Page/Folio 290, in the Office of the Clerk of the Superior Court of Muscogee County, Georgia. Said tract of land being the same as that certain tract or parcel of land being more particularly shown and delineated in that certain Plat of Survey for Jane Busby Payne, prepared and certified by Thomas L. French, Jr., Georgia Registered Land Surveyor No. 1171, dated August 24, 1970, as shown per Plat thereof recorded in Plat Book 48, Page/Folio 26, in the Office of the Clerk of the Superior Court of Muscogee County, Georgia, which said Plat is incorporated herein and made a part hereto by reference for a more detailed and accurate description hereof. Said tract of land being improved property as located at No. 3 Kent Court, according to the present system of numbering houses in the City of Columbus, Muscogee County, Georgia. And said tract of land being more particularly described as follows: Beginning at a point located at the intersection of the Northerly right-of-way of Esquiline Drive (having a 50-foot right-of-way) with the Westerly right-ofway, as curved to form an angle instead of a corner, of Kent Court (having a 60-foot right-of-way); running thence Northwesterly and Westerly, along the said Northerly right-of-way of Esquiline Drive (having a 50-foot right-of-way) and following the curvature thereof, along the arc of a curve to the left (having a radius of 160.56 feet), an arc distance of 52.70 feet to a point located at the intersection of the Southeast corner of Lot 6, Block "F", of Esquiline Hills Subdivision, per Plat Book 06, Page/Folio 290, in the aforesaid records, with the said Northerly right-of-way of Esquiline Drive (having a 50-foot right-ofway); running thence, and leaving said right-of-way of Esquiline Drive (having a 50-foot right-of-way), North 09 degrees 15 minutes 00 seconds West, a distance of 80.60 feet to a point; running thence South 87 degrees 46 minutes 00 seconds West, a distance of 12.00 feet, to a point located on the Easterly lot line of said Lot 6, Block "F", of said Subdivision and Plat; running thence, along the said Easterly lot line of said Lot 6, Block "F", of said Subdivision and Plat, North 17 degrees 30 minutes 00 seconds West, a distance of 19.00 feet to a point; running thence, and leaving said Easterly lot line of said Lot 6, Block "F", of said Subdivision and Plat, North 87 degrees 44 minutes 00 seconds East, a distance of 106.55 feet to a point located on the Westerly right-of-way of Kent Court (having a 60-foot right-of-way); running thence, along said Westerly right-of-way of Kent Court (having a 60-foot right-of-way), South 02 degrees 16 minutes 00 seconds East, a distance of 95.28 feet to a point; running thence South, Southwesterly, Westerly, and, then, Northwesterly, along the Westerly, Northwesterly and Northerly right-of-way of Kent Court (having a 60-foot right-of-way) and following the curvature thereof, along the arc of a curve to the right (having a radius of 20.12 feet), an arc distance of 40.78 feet to the Point of Beginning. Said tract of land is also described in the Scrivner's Affidavit by Attorney James R. Warner, dated November 21, 2022, and recorded in Deed Book 4012 Page 161, Muscogee County, Georgia, which clarifies that said of tract of land is the largest parcel designated as "Part of Lot Numbered Seven (7)" on the plat recorded at Plat Book 48, Page/Folio 26, in the Office of the Clerk of the Superior Court of Muscogee County, Georgia. (the "Property"). The debt secured by said Security Deed has been and is hereby declared due because of, among other possible events of default, failure to pay the indebtedness as and when due and in the manner provided in the Note and Security Deed. The debt remaining in default, this sale will be made for the purpose of paying the same and all expenses of this sale, as provided in the Security Deed and by law, including attorney's fees (notice of intent to collect attorney's fees having been given). Said property is commonly known as 3 Kent Ct, Columbus, GA 31903 together with all fixtures and personal property attached to and constituting a part of said property, if any. The sale will be conducted subject to (1) confirmation that the sale is not prohibited under the U.S. Bankruptcy Code; and (2) final confirmation and audit of the status of the loan with the holder of the Security Deed.
