BY VIRTUE OF A DECREE of the Court of Common Pleas for Newberry County, South Carolina, heretofore issued in the case of NewRez LLC d/b/a Shellpoint Mortgage Servicing vs. Joseph A Teseniar a/k/a Joseph A Teseniar, Sr, a/k/a Joseph Adam Teseniar, Sr; Credit Corp Solutions Inc. I the undersigned as Special Referee for Newberry County, will sell on July 6, 2026 at 11:00 AM at Newberry County Court House, Newberry, South Carolina 29108 to the highest bidder:
Legal Description and Property Address:
ALL THAT PIECE, PARCEL OR TRACT OF LAND, LYING AND BEING SITUATE IN THE COUNTY OF NEWBERRY, STATE OF SOUTH CAROLINA, BEING THREE (3.0) ACRES, MORE OR LESS, WITH A TWENTY (20.0) FOOT EASEMENT FOR INGRESS AND EGRESS, LOCATED ON ADAM TESENIAR ROAD, AND BEING MORE PARTICULARLY DESCRIBED ON A PLAT BY THOMAS D. SHERBERT, JR., SCPLS 4555 DATED JANUARY 18, 2002 AND RECORDED IN THE OFFICE OF THE CLERK OF COURT FOR NEWBERRY COUNTY IN PLAT BOOK BOOK 6, AT PAGE 665.
THIS BEING the same property conveyed unto Joseph Adam Teseniar, Sr. by virtue of a Deed from Robert D. Teseniar dated March 7, 2002 and recorded March 7, 2002 in Book 581 at Page 313 in the Office of the Clerk of Court for Newberry County, South Carolina.
THEREAFTER, Joseph A. Teseniar conveyed an undivided one-half (1/2) interest in the subject property unto Lavada A. Teseniar by virtue of a Deed dated April 16, 2002 and recorded April 17, 2022 in Book 584 at Page 91 in the Office of the Clerk of Court for Newberry County, South Carolina.
THEREAFTER, Lavada A. Teseniar aka Lavada Preston Teseniar's interest in the subject property was conveyed unto Joseph Adam Teseniar, Sr. by Joseph Adam Teseniar, Sr, as Personal Representative of the Estate of Lavada Preston Teseniar, (Estate # 2022-ES-36-00181), pursuant to the probate of said Estate, and by virtue of a Deed of Distribution dated March 2, 2023 and recorded March 6, 2023 in Book 2498 at Page 234 in the Office of the Clerk of Court for Newberry County, South Carolina.
THEREAFTER, Joseph A. Teseniar, Jr. and Christopher D. Teseniar conveyed all their interest in the subject property unto Joseph A. Teseniar, Sr. by virtue of a Quit-Claim Deed dated March 2, 2023 and recorded March 6, 2023 in Book 2498 at Page 236 in the Office of the Clerk of Court for Newberry County, South Carolina.

TERMS OF SALE: For cash. Interest at the current rate of 6.5% to be paid on balance of bid from date of sale to date of compliance. The purchaser to pay for papers and stamps, and that the successful bidder or bidders, other than the Plaintiff therein, will, upon the acceptance of his or her bid, deposit with the Special Referee for Newberry County a certified check or cash in the amount equal to five percent (5%) of the amount of bid on said premises at the sale as evidence of good faith in bidding, and subject to any resale of said premises under Order of this Court; and in the event the said purchaser or purchasers fail to comply with the terms of sale within Thirty (30) days, the Special Referee for Newberry County shall forthwith resell the said property, after the due notice and advertisement, and shall continue to sell the same each subsequent sales day until a purchaser, who shall comply with the terms of sale, shall be obtained, such sales to be made at the risk of the former purchaser. Since a personal or deficiency judgment is waived, the bidding will not remain open but compliance with the bid may be made immediately. Plaintiff may waive any of its rights prior to sale. Sold subject to taxes and assessments, existing easements and restrictions of record. Neither the Court, nor Plaintiff, nor Plaintiff's counsel makes any warranty of title or representations with regard to the condition or existence of any improvements on the subject property. Prospective bidders may wish to assess these matters to their satisfaction prior to sale.
