
NOTICE OF 30-DAY PUBLIC COMMENT PERIOD

The South Carolina Department of Environmental Services (SCDES) is accepting public comments on a proposed Voluntary Cleanup Contract through April 28, 2026.
The Voluntary Cleanup Contract, 26-8886-NRP, will affect approximately 1.01 acres located at 10 and 16 Carillon Court and 3327 Forest Drive, Columbia, South Carolina. The property is further identified by Richland County Tax Map Serial Numbers R14001-08-10 and R14001-08-11. CG Columbia 2, LLC ("CGC") wants to acquire the property and intends to develop it as a drive through restaurant.
The property was first developed for commercial and residential use in the 1960s. A gasoline fueling station was present on the property until the late 1970s. The property was finally developed into its current configuration as office spaces and an animal hospital in 1980. The past use of the property may have caused environmental pollution on the property.
SCDES uses Voluntary Cleanup Contracts to encourage productive reuse of Brownfield properties. If this Voluntary Cleanup Contract is implemented, SCDES will allow CGC to acquire the property as a "Brownfields Development" because of the potential for environmental pollution from past activity on the property.
SCDES will not hold CGC responsible for pre-existing pollution in exchange for doing work under the Voluntary Cleanup Contract. Under the proposed contract, CGC will test soil, groundwater, and soil vapor on the property. If significant contamination is found, CGC will be required to take steps to protect human health and the environment. CGC did not create the pollution but will control it to keep the property safe for re-use. Under state law, CGC will not be responsible if anyone has been affected by the contamination. The responsibility of former owners or operators of the property is not reduced by this contract.
