NOTICE OF CLASS 3 PERMIT MODIFICATION REQUEST AERC Acquisition Corporation d/b/a DART, A Clean Earth Company (Permittee) operates a hazardous waste management facility at 4132 Pompano Road in Charlotte, NC 28216 (Facility) under Permit No. NCD121700777 R3, issued by NCDEQ Division of Waste Management (NCDEQ). Modification Request. Per 40 CFR 270.42(c)(2), the Permittee is notifying the public of a request submitted to NCDEQ for a Class 3 permit modification. The modification requests authorization to install and operate an inorganic treatment system to treat commercially available consumer pool tablets, pool shock, chlorinated liquids, and concentrated acids. The modification is needed so that the Facility may process and treat waste streams that are already permitted for acceptance and storage at the Facility and thus eliminate off-site shipments of concentrated acids or chlorine-related oxidizers. Public Comment Period. The public is invited to submit written comments on this modification request during a 60-day comment period beginning the date this notice is published. Comments must be received or postmarked by December 1, 2026 and should be sent to NCDEQ Division of Waste Management, Hazardous Waste Section, 1646 Mail Service Center, Raleigh, NC 27699-1646.
