Dated June 28, 2024, recorded in Book 38914, at Page 821 Securing the original amount of $2,100,000.00 NOTICE OF FORECLOSURE SALE Under and by virtue of the power of sale contained in that certain Deed of Trust executed by Carolina Development Group NC, LLC, described above, in the Mecklenburg County Public Registry; default having been made in the payment of the indebtedness thereby secured and the said Deed of Trust being by the terms thereof subject to foreclosure; and the holder of the indebtedness thereby secured having demanded a foreclosure thereof for the purpose of satisfying said indebtedness; and under and by virtue of an order entered in the within entitled and numbered action by the Clerk of Superior Court of Mecklenburg County, North Carolina on the 15th day of May, 2026, the undersigned Trustee will offer for sale at public auction to the highest bidder for cash on the First Floor of the Courthouse in the usual place in Charlotte, North Carolina at 12:00 P.M. on Wednesday the 23rd day of September, 2026, the land conveyed in said Deed of Trust, the same lying and being in Mecklenburg County, North Carolina, and being more particularly described as follows: BEING all of Lot 3 as shown upon the unrecorded map of THE H.E. KISER FAMILY TRUST PROPERTY, and being more particularly described as follows: BEGINNING at an iron in the center line of Youngblood Road (S.R. #1102) at the common from corner of Lots 3 and 4, said iron being located S. 84-43-42 E. 2,039.42 feet to the center line of McKee Road at its intersection with Youngblood Road, and runs thence with the said center line of Youngblood Roads 85-50-59 W. 275.03 feet to an iron; thence N. 02-11-21 W. 401.75 feet to an iron; thence S. 48-50-37 E. 138.39 feet to an iron; thence S. 48-50-27 E. 239.59 feet to an iron; thence with the common line of Lots 3 and 4 S. 02-11-21 E. 1,132.89 feet to the place of BEGINNING, and containing 7.99 acres as shown on survey of Jack R. Christian, R.S. dated June 8, 1994. Also shown as Lot 3 on a Boundary Survey for H. E. Kiser Family Trust, Map 2, recorded in Plat Book 26 at Page 273 in the Mecklenburg County Register of Deeds. Notice is further hereby given that the sale will be conducted pursuant to and subject to all of the provisions of Chapter 45, as amended, of the General Statutes of North Carolina. Notice is given that an order for possession of the property may be issued pursuant to N.C.G.S. §45-21.29 in favor of the purchaser and against the party or parties in possession by the Clerk of Superior Court of the County in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement by providing written notice of termination to the landlord, to be effective on a date stated in the notice that is at least 10 days, but no more than 90 days, after the sale date contained in the notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination.
