TAKE NOTICE that a pleading seeking relief against you has been filed in the above-entitled action. The nature of the relief being sought is as follows: On or about August 23, 2023, Betzaida Coromoto Lugo ("Defendant") executed a Security Agreement and Advance Receipt (the "Security Agreement") with Founders Federal Credit Union ("Plaintiff"). Pursuant to the Security Agreement, Plaintiff advanced funds to Defendant for the purchase of a 2022 Toyota Highlander VIN # 5TDCARAHXNS556672 (the "Collateral"), and Defendant granted Plaintiff a security interest in the Collateral. Defendant failed to make payments when due under the Security Agreement and is in default of her obligations thereunder. After providing all credits due to Defendant, including a credit for the proceeds received from the sale of the Collateral, Defendant remains indebted to Plaintiff under the Security Agreement in the amount of no less than $17,802.60, plus interest accruing thereon at the rate of $3.259 per day from and after August 7, 2026 until the date of judgment, and thereafter at the lower of the maximum legal rate or the rate of the Security Agreement until paid. On or about July 24, 2024, Defendant executed a Consumer Lending Plan Advance Receipt and Truth-in-Lending Statement (the "Note") with Plaintiff. Defendant failed to make payments when due under the Note and is in default of her obligations thereunder. After providing all credits due to Defendant, Defendant remains indebted to Plaintiff under the Note in the amount of no less than $6,254.37, plus interest accruing thereon at the rate of $2.407 per day from and after August 7, 2026 until the date of judgment, and thereafter at the lower of the maximum legal rate or the rate of the Security Agreement until paid.
You are required to make defense to such pleading no later than October 9, 2026, said date being 40 days from the date of first publication of this notice, and upon your failure to do so the party seeking service against you will apply to the court for the relief sought.
