NOTICE OF PUBLIC HEARING – 2026.09.08 WAXHAW BOARD OF COMMISSIONERS RESOLUTION OF INTENT TO CONSIDER THE ABANDONMENT OF RIGHT OF WAY A Resolution of Intent to Consider the abandonment of the right of way of a portion of Prescott Glen Parkway has been presented to the Board of Commissioners in accordance with North Carolina General Statute 160A-299, which authorizes Board of Commissioners of the Town of Waxhaw to close streets and public alleys. A public hearing has been scheduled for the purposes of receiving public comments pertaining to this Resolution of Intent on Tuesday, September 8, 2026, at 6:30 pm or soon thereafter in the Waxhaw Town Hall Board Chambers, located at 4218 Waxhaw-Marvin Road, Waxhaw, NC on the following item(s): Resolution RES2026017 WHEREAS, a portion of the public right-of-way for Prescot Glen Parkway containing 1.09 acres, located within the Town of Waxhaw, has been proposed for permanent closure and abandonment; WHEREAS, the portion of the public right-of-way proposed for closure is more particularly described in the legal description and survey attached hereto as "Exhibit A" and incorporated herein by reference; WHEREAS, pursuant to N.C.G.S. § 160A-299, the Board of Commissioners must adopt a resolution declaring its intent to consider permanently closing the public right-of-way and calling for a public hearing on the proposed closure; and WHEREAS, the Board of Commissioners desires to provide all interested persons an opportunity to be heard regarding whether the proposed closure would be detrimental to the public interest or the property rights of any individual. NOW, THEREFORE, BE IT RESOLVED by the Board of Commissioners of the Town of Waxhaw, North Carolina, as follows: Section 1. Declaration of Intent. The Board of Commissioners hereby declares its intent to consider permanently closing and abandoning the portion of the public right-of-way for Prescot Glen Parkway described in Exhibit A. Section 2. Public Hearing. A public hearing concerning the proposed right-of-way closure shall be held during the Board of Commissioners' regular meeting on September 8, 2026, beginning at 6:30 p.m., in the Town Hall Board Chamber, 4218 Waxhaw-Marvin Road, Waxhaw, North Carolina. Section 3. Notice. The Town Clerk is authorized and directed to provide notice of the proposed closure and public hearing in accordance with N.C.G.S. § 160A-299, including: 1. Publishing this resolution once a week for four (4) successive weeks before the public hearing; 2. Sending a copy of this resolution by registered or certified mail to all owners of property adjoining the portion of the right-of-way proposed for closure, as shown in the Union County tax records; 3. Prominently posting notice of the proposed closure and public hearing in at least two places along the affected portion of the right-of-way; and Section 4. No Final Action. This resolution declares only the Board's intent to consider the proposed closure. The Board will not take final action regarding the closure until after conducting the required public hearing and determining whether the closure would be contrary to the public interest or would deprive any property owner in the vicinity or subdivision of reasonable ingress and egress to the owner's property. Section 5. Effective Date. This resolution shall become effective upon its adoption. Duly adopted on this the 28th day of July 2026. The public is invited to attend the hearing to comment on the proposed closing of the public right of way.
