Johnnie A. Bennett, Jr., as Personal Representative for the Estate of Johnnie A. Bennett, Sr., v. Charles W. Earp, Rachelean S. Salley, William C. Jones, and Estate of Eddie Lee Salley and all persons Claiming any right, title, estate Interest in or lien upon the real estate described; any unknown adults being as a class designated as John Doe, whose true name is unknown; and any unborn infants or persons under disability being as a class designated as Richard Roe, whose true name is unknown.
LIS PENDENS - NOTICE IS HEREBY GIVEN an action will be commenced within twenty (20) days in this Court, upon a Quiet Title Complaint by the above-named Plaintiff against the above-named Defendants to quiet title to property located in Richland County. The property that is subject of the action is described as follows: All that certain piece, parcel, or lot of land, lying in the County of Richland, State of South Carolina being shown as Lot 24, Block B on a plat of Lincolnshire by McMillan Engineering Co., dated October 1, 1968 and recorded in the Richland County ROD in Plat Box X at Page 810. Said plat being hereto craved for a more complete and accurate description of said lot. This being the same property conveyed by Eddie Lee Salley by deed unto Charles W. Earp and William C. Jones and recorded in the Richland County ROD on July 2, 1987 in Deed Book D 848 at Page 185; and furthermore a one-half interest was ordered to be given pursuant to the order of Richland County Judge, Carol Conner, dated July 6, 1993, Case #90-CP-40-2318 filed in judgment No. 190093, wherein Clerk of Court, Barbara A. Scott acted as Grantor and duly executed a deed for this one-half interest unto Eddie Salley and Rachlean Salley. Said order (deed) recorded in the Richland County ROD on November 15, 1993, in Deed Book D 1169 at Page 664. TMS Map No.: 09514-02-04
SUMMONS -YOU ARE HEREBY SUMMONED and required to answer the Complaint in this action, of which a copy is herewith served upon you, and to serve a copy of your Answer to the said Complaint on the subscribers at their office at Post Office Box 11844, Columbia, South Carolina 29211, within 30 days after the service hereof; exclusive of the day of such service; and if you fail to answer and defend the Complaint within the time aforesaid; the Plaintiff in this action will apply to the Court for the relief demanded in the complaint and judgment by default will be rendered against you for the relief demanded in the Complaint.
NOTICE OF APPOINTMENT OF GUARDIAN AD LITEM
As a Complaint has been filed in this Court that requires the appointment of a Guardian ad Litem (GAL) for the above-named unknown individuals, I hereby appoint Elnora J. Dean as GAL in accordance with S.C. Code Ann. §§ 62-5-303B. I direct that the GAL shall have access to all reports, records in order to ascertain the facts. The GAL is also entitled to receive copies of any existing will. The GAL shall file with the Court and serve a written report with recommendations on all parties forty-eight (48) hours prior to the Court hearing unless otherwise ordered by the Court. In that the person serving as a GAL acts as the Court's agent, she is entitled to quasi-judicial immunity for acts performed within the scope of her duties as the GAL. Once a guardian is appointed, or the Court issues another final order, the GAL's role in this matter is terminated. THEREFORE, IT IS HEREBY ORDERED that Elnora J. Dean is appointed Guardian ad Litem in this matter and the above directives of the Court are to be followed. IT IS SO ORDERED.
ORDER OF PUBLICATION
HAVING READ and filed the Petition of Kenneth A. Davis, attorney for the Plaintiff herein, and it appearing that this is an action to Quiet Title to the property situated in Richland County, South Carolina, and further, that the Defendants, John Doe and Richard Roe, cannot, after due diligence be located in said County and State. IT IS ORDERED that service in this matter be made on the Defendants, John Doe and Richard Roe, by publishing copies of the Lis Pendens, Summons, Notice of Order Appointing Guardian ad Litem, and Order of Publication by publication in the "Columbia Star," a newspaper in Columbia, South Carolina.
