Notice of Sale of Real Property State of North Carolina County of Mecklenburg in the General Court of Justice before the Clerk#26SP000151-590 in the matter of the proposed foreclosure of claim of lien filed against Providence Hospitality LLC by Pawtuckett-On-The-Green Homeowners' Association, Ltd recorded April, 11, 2025 In Docket # 25M001487-590 in the Office of the Clerk of Superior Court for Mecklenburg County. Under and by virtue of the authority of the North Carolina statutes, the applicable declarations and/or restrictions filed of record, and Claim of Lien filed by Pawtuckett-On-The-Green Homeowners' Association, Ltd (hereinafter "the Association") recorded in the Office of the Clerk of Superior Court for Mecklenburg County, North Carolina, in docket #25M001487-590, and because of the owner's default in the payment of the indebtedness secured by the Claim of Lien, pursuant to demand of the Petitioner, the undersigned will expose for sale at public auction to the highest bidder for cash the property therein described, to wit: TRACT 1: BEING all of the Condominium Unit No. 9123-K SPYGLASS PLACE of the Pawtuckett-on-the-Green Condominiums, as described in the Declaration of the Pawtuckett-on-the-Green Condominiums, recorded in Deed Book 4389 at Page 157 in the office of the Register of Deeds for Mecklenburg County, North Carolina, and more particularly described in the Plans recorded in the Unit Ownership File No. 102 in said Register. TRACT 2: A 0.6324 percent undivided interest in the Common Areas and Facilities as referred to in the said Declaration, to which reference is made for a more particular description. Address of Property: 9123-K Spyglass Place, Charlotte, 28214 Present Record Owners: Providence Hospitality LLC Trustee may, in the Trustee's sole discretion, may delay the sale for up to an hour as provided in N.C.G.S. §45-21.23. Said property is sold subject to applicable Federal and State laws. A deposit of the greater of five percent (5%) of the amount of the bid or Seven Hundred Fifty Dollars ($750.00) is required and must be tendered in the form of cash or certified funds at the time of the sale. Should the property be purchased by a third party, that party must pay the excise tax, any Land Transfer Tax, as well as court costs of Forty-Five Cents ($0.45) per One Hundred Dollars ($100.00) required by N.C.G.S. §7A-308(a)(1). The real property described above is being offered for sale "AS IS, WHERE IS" and will be sold subject to any and all superior liens, including taxes and special assessments. Neither the Trustee nor the holder of the Debt secured by the Claim of Lien being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representatives of either of them make any representation or warranty relating to the title or physical, environmental, health or safety conditions existing in, on, at or relating to the property being offered for sale, and any and all responsibilities or liabilities arising out of or in any way relating to any such condition are disclaimed expressly. The sale will be held open for ten (10) days for upset bids as required by law. If the Trustee is unable to convey title to this property for any reason, the sole remedy of the purchaser is the return of the deposit. If the validity of the sale is challenged by any party, the Trustee, in its sole discretion, if it believes the challenge to have merit, may declare the sale void and return the deposit. The purchaser will have no further remedy. The notice of sale of residential real property with less than 15 rental units shall also state all of the following: That an order for possession of the property may be issued pursuant to G.S. 45-21.29 in favor of the purchaser and against the party or parties in possession by the clerk of superior court of the county in which the property is sold. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the notice of sale, terminate the rental agreement by providing written notice of termination to the landlord to be effective on a date stated in the notice that is at least 10 days, but no more than 90 days, after the sale date contained in the notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination. Upon termination of a rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination. Hour and Date of Sale: May 5, 2026 at 11:00A.M.
