The nature of the relief being sought is as follows: 1. The Court determine the Deed of Trust recorded on May 22, 2020, in Book 34602 at Page 975 in the Mecklenburg County Registry was drafted and recorded in a manner sufficient to give a reasonable title searcher notice of the interest of the Plaintiff's lien on the property located at 11532 Candlelight Ct, Charlotte, North Carolina 28226. 2. The Court declare the Deed of Trust recorded on May 22, 2020, in Book 34602 at Page 975 in the Mecklenburg County Registry is a valid First Lien on the Property as drawn; 3. In the alternative, that the Court declares the current record owners hold the Property described herein subject to a constructive trust and equitable lien to the benefit of the Plaintiff, consistent in all regards with the terms and conditions of the Deed of Trust. 4. That the Court enter an Order declaring that Defendant All Lawful Heirs of Burkhard J. Doering have no interest in the Subject Property and that title to same should be quieted in the name of the current record owners thereof, subject to Plaintiff's Deed of Trust recorded in Book 34602 at Page 975. 5. That the Court's Order, shall be duly recorded in the Mecklenburg County Register of Deeds and indexed according to those parties named in said Deed of Trust and named herein for the purpose of establishing record notice of this proceeding in the chain of title to the Property; and 6. For such other and further relief as the Court deems just and proper. You are required to make defense to such pleading not later than May 19, 2026 and upon your failure to do so the party seeking service against you will apply to the court for the relief sought.
