Sheila Russell and Wayne Russell Funeral Service, LLC Wake County Superior File No. 26CV006967-910 Complaint and Motion and Application for Preliminary and Permanent Injunction to Sheila Russell: TAKE NOTICE that a pleading seeking relief against you has been filed on February 19, 2026, in the above-entitled action. The nature of the relief being sought is as follows: That Defendant Sheila Russell be preliminarily and permanently enjoined from the practice of funeral services in the State of North Carolina until such time, if ever, that Defendant become property licensed by Plaintiff. That Defendant disclose to Plaintiff the names and contact information of any consumers from whom Defendant have accepted preneed funeral funds since September 2014. That Defendant be ordered to return any and all monies taken as preneed funeral funds for Withers' future funeral services to Withers or his fiduciary. That the Court's order provides that the injunction shall be enforceable by and through the contempt powers of this Court, pursuant to G.S. §§ 5A-11 and 5A-23. That Plaintiff be awarded its costs, including reasonable attorneys' fees pursuant to G.S. 90-210.25(g). That Plaintiff has and recovers such other and further relief against Defendant as the Court may deem just and proper. You are required to make defense to such pleading not later than 40 days from March 31, 2026, and upon your failure to do so the party seeking service against you will apply to the court for the relief sought.
