NOTICE The City of Concord Alcohol Beverage Control Board hereby gives notice that it has accepted a negotiated offer to sell property pursuant to NCGS Section 160A-269. Description of the Real Property: Being a PORTION of Cabarrus County Tax Parcel Identification Number 5539751523000, which was conveyed by deed recorded in Book 17230 Page 228 of the Cabarrus County Register of Deeds and being generally described as: Lying and being in the City of Concord, Number Eleven (11) Township of Cabarrus County, North Carolina and Being all of Lot Number 1 (containing 0.861 acre, more or less) and Lot Number 2 (containing 2.076 acres, more or less) as shown on the survey for Troutman Land Investments, Inc. known as "2.937 Ac-US Hwy 601", as surveyed and platted, a copy of which plat is filed in the Office of the Register of Deeds for Cabarrus County in Map Book 70, Page 11, to which map book and page reference is hereby made for a complete description thereof by metes and bounds. LESS AND EXCEPTING an approximate 0.72 acre parcel to be retained by City of Concord Alcohol Beverage Control Board and to be finalized pursuant to a subdivision plat that will completed and recorded as part of the Closing. The approximate Real Property being sold is depicted on Exhibit C in the Agreement (as defined hereinbelow). Purchase Price: The Purchase Price is $2,000,000.00. The purchase is subject to the terms contained in a written Agreement for Purchase and Sale of Improved Real Property between the City of Concord Alcohol Beverage Control Board as Seller and Piqua Tso Partners, LLC as Buyer (the "Agreement"). Amongst other terms, the Agreement is contingent upon the parties (i) commissioning, agreeing to and recording a Subdivision Plat dividing Cabarrus County Tax Parcel Identification Number 5539751523000 and which shall be recorded at Closing, (ii) the parties agreeing to and entering into a reciprocal easement and maintenance agreement for access, utility, parking, signage and storm drainage, which shall be recorded at Closing, (iii) title to the Property shall be conveyed subject to certain title exceptions, which shall include that the Property is subject to the constraints that no school, church or related use may be located within four hundred fifty (450) feet of the retained ABC Parcel and (iv) the parties agreeing to and entering into a post-closing agreement for certain construction work and improvements to the parking lot and property to be completed by Buyer after Closing (the" Work"). A list of the agreed upon Work is more particularly set forth in Exhibit D of the Agreement. Any potential bidders may obtain a copy of the Agreement by contacting Belinda Aponte, General Manager for City of Concord Alcohol Beverage Control Board at belinda@concordabcboard.com or 704-787-9453. Anyone wanting to place an upset bid may do so by increasing the Purchase Price by 10% of the first $1,000.00 and 5% of the remainder. In addition, a non-refundable deposit of 5% of the upset bid must be deposited with Belinda Aponte at the time the upset bid is made. Any upset bid must be made by 5:00pm within ten (10) days of the advertisement of this notice. Upon any upset bid being made a new notice for upset bids shall be advertised and this process shall continue until no further upset bids are received.
