PUBLIC NOTICE of Amendment to Mecklenburg County Board of Health Rule Governing Child Day Care Homes The Mecklenburg County Board of Commissioners, as a Consolidated Human Services Agency (CHSA) exercising the powers and duties of a local board of health, which powers it has assumed and conferred on itself by action pursuant to N.C.G.S. 153A-77, finds and declares that, in order to protect the public health and welfare, it is in the best interest of the residents of Mecklenburg County to amend the Board of Health Rule adopted May 2, 2023, under N.C.G.S. 130A-39 governing child day care homes in Mecklenburg County and all Cities and Towns, whether incorporated or unincorporated. The Mecklenburg County Board of Commissioners, as a Consolidated Human Services Agency (CHSA), exercising the powers and duties of a local board of health, and having the authority cited herein and in the interest of public health and safety, hereby amends this Board of Health Rule, which, among other changes, replaces the name "Child Day Care Homes" with "Family Child Care Homes"; updates the definition of "child care"; removes enforcement of building code and zoning requirements; removes requirements related to swimming pools on property; updates sanitation requirements; adds personnel health, safety, and hygiene requirements; and adds authority for the Health Director to suspend or revoke permits for failure to comply with the Rule. This notice was published on March 6, 2026, and the amendments shall be effective ten (10) days after the date of this publication upon Board approval.
