PUBLIC NOTICE
of
Amendment to Mecklenburg County Board of Health Rule Governing Groundwater Wells
The Mecklenburg County Board of Commissioners, as a Consolidated Human Services Agency (CHSA) exercising the powers and duties of a local board of health, which powers it has assumed and conferred on itself by action pursuant to N.C.G.S. 153A-77, finds and declares that, in order to protect the public health and welfare, it is in the best interest of the residents of Mecklenburg County to amend the Board of Health Rule adopted April 19, 2011, under N.C.G.S. 130A-39 governing groundwater wells in Mecklenburg County and all Cities and Towns, whether incorporated or unincorporated. The Mecklenburg County Board of Commissioners, as a Consolidated Human Services Agency (CHSA), exercising the powers and duties of a local board of health, and having the authority cited herein and in the interest of public health and safety, hereby amends this Board of Health Rule, which, among other changes, divides the current Rule into two (2) new Rules, one for Private Drinking Water Supply Wells, and one for Wells Other Than Drinking Water Supply Wells; removes well construction standards (State construction standards will apply); removes requirements for community and non-transient non-community water supply wells (State permitting and regulations will apply); updates statutory references; and adds an appeals procedure consistent with N.C.G.S. 130A-24. For Private Drinking Water Supply Wells, Areas of Regulated Groundwater Usage (ARGU) reviews that require restrictions (i.e., requiring full grout or sampling requirements) will be required to be recorded with the Register of Deeds prior to issuing a well permit. For Wells Other Than Drinking Water Supply Wells, sites designated at high-risk will not be exempt from monitoring well payments.
This notice was published on March 6, 2026, and the amendments shall be effective ten (10) days after the date of this publication upon Board approval.
