NOTICE OF SALE
Under the power and authority contained in that North Carolina Deed of Trust executed by Paradigm Shifterz, LLC (Borrower) in favor of K4 Investments, LLC recorded June 7, 2024 in Book 38868 at Page 430 in the Office of the Register of Deeds, Mecklenburg County Register of Deeds (the "Deed of Trust"), and pursuant to the Order of Foreclosure of the Clerk of Superior Court for Mecklenburg County, North Carolina, entered in this foreclosure proceeding on January 12, 2026 the undersigned Trustee will expose for sale at public auction on Monday, March 16, 2026 at 12:00 p.m. at the location designated for foreclosure sales on the first floor at the MECKLENBURG COUNTY COURTHOUSE, 832 4TH STREET, CHARLOTTE, NC 28202 the following described real property (including any improvements thereon):
BEGINNING at a point in the center line of the right of way of a 60-foot unnamed street; said point of beginning being the northeasterly corner of that certain 3.00 acre tract of land conveyed to Randolph Raley and wife, Maggie Raley by deed of Lawrence Gray dated October 19, 1976, and duly recorded in Book 3888 at Page 869 of the Mecklenburg County Public Registry, and running thence with the northerly boundary of the Raley land two courses and distances as follows: (1) N. 63-59-10 W. 29.82 feet to an iron located in the westerly boundary of the right of way of the said 60-foot unnamed street; (2) N. 69-29-25 W, 417.94 feet to an iron in the easterly boundary of the land of M. E. Oehler (now or formerly) and running thence with Oehler's easterly boundary N. 25-29-37 E. 517.0 feet to an iron, the southwesterly corner of the land of Louis J. Brown; thence with the southerly boundary of the Brown land S. 46-48-40 E. 540.75 feet to a point in the center line of said street S. 38-34-30 W. 318.31 feet to a point; thence continuing with the center line of said street in a southwesterly direction with the arc of a circular curve to the left having a radius of 392.07 feet an arc distance of 6.69 feet to the point of beginning, the same containing 4.656 acres as being shown on survey of Henry L. Parnell dated June 17, 1976.

Beginning at a point located 90.00 feet left of centerline station 14+97.15 of centerline-RPBY22; thence from said Point of Beginning S 76 deg. 11 min. 43 sec. E for a distance of 504.35 feet to a point; thence S 37 deg. 26 min. 30 sec. W for a distance of 221.78 feet to a point; thence S 36 deg. 57 min. 36 sec. W for a distance of 6.68 feet to a point; thence N 65 deg. 07 min. 17 sec. W for a distance of 29.81 feet to a point; thence N 70 deg. 37 min. 21 sec. W for a distance of 417.11 feet to a point; thence N 24 deg. 46 min. 07 sec. E for a distance of 166.12 feel to the Point of Beginning.
The record owner of the property as reflected on the records of the Register of Deeds' office not more than ten (10) days prior to the posting of this notice is Borrower. The sale will be made subject to all prior liens, restrictions, and easements of record and all unpaid taxes and assessments. The property is not being sold subject to or together with any subordinate rights or interests.
The above-described property will be sold "AS IS, WHERE IS." Neither the Substitute Trustee nor the holder of the Note secured by the Deed of Trust being foreclosed, nor the officers, directors, attorneys, employees, agents or authorized representatives of either the Substitute Trustee or the holder of the Note make any representation or warranty relating to the title or any physical, environmental, health or safety conditions existing in, on, at or relating to the real property being sold, and any and all responsibilities or liabilities arising out of or in any way relating to any such conditions expressly are disclaimed.
An Order for Possession of the property may be issued pursuant to N.C. Gen. Stat. § 45-21.29 in favor of the purchaser and against the party or parties in possession by the Clerk of Superior Court of the County in which the property is sold.
The successful purchaser must pay the fee of forty-five cents (45¢) per one hundred dollars required by N. C. Gen. Stat. § 7A-308(a)(1) and all excise taxes, recording fees, and revenue stamps charged in connection with the deed transferring title. Pursuant to N.C. Gen. Stat. § 45-21.10(b) and the terms of the Deed of Trust, the successful bidder may be required to deposit with the Substitute Trustee immediately upon conclusion of the sale, a cash deposit equal to the greater of five percent (5.0%) of the bid amount or $750.00.
Any successful bidder shall be required to tender the full purchase price bid, less any deposit, in cash or certified check at the time the Substitute Trustee tenders or attempts to tender a deed for the property. Should the successful bidder fail to pay the required amount at that time, he/she shall remain liable on his/her bid as provided for in North Carolina General Statutes § 45-21.30(d) and (e). The sale will be held open ten (10) days for upset bids as required by law.
