NOTICE OF SALE Under the authority and direction of a Judgment of Foreclosure and Sale in Treetops Owners' Association v. Robert E. Kitty, et al., Civil Action No. 2022-CP-07-01530, dated November 13, 2025, I will offer for sale at public auction at the Beaufort County Courthouse, 102 Ribaut Road, Beaufort, South Carolina, to the highest bidder, for cashier's check (or equivalent), on Monday, February 2, 2026, during the legal hours of sale, beginning at 11:00 a.m., the following described property: ALL that certain Condominium Apartment lying and being on Hilton Head Island, Beaufort County, South Carolina, and being known as Apartment No. 7804, Treetops Horizontal Property Regime, and being more particularly shown and described by reference to the Master Deed of Treetops Horizontal Property Regime, recorded on December 30, 1983 in Deed Book 385 at Page 103, and re-recorded on February 3, 1984 in Deed Book 387 at Page 1110, and all amendments thereto. This being the same property or a portion thereof conveyed to Robert E. Kitty by Quit Claim Deed, dated March 19, 2013 and recorded on March 22, 2013, in the Office of the Register of Deeds for Beaufort County, South Carolina in Book 3225 at Page 0452. Tax Map Ref.: R553-018-000-250A-7804 Current Address: 137 Cordillo Court Parkway, #7804 Hilton Head Island, SC 29928 Plaintiff having demanded a deficiency judgment, the bidding will remain open for 30 days after the date of sale. Plaintiff reserves the right to waive its right to a deficiency judgment prior to sale. If this right is waived, the bidding will not remain open. The Sale shall require the highest bidder, other than Plaintiff, to make a deposit of 5% of the bid. If Plaintiff is the successful bidder at the Sale, the amount due on its lien may be used. Should the person making the highest bid at the Sale fail to comply with the terms of his bid by depositing said 5%, then the premises shall be resold at such bidder's risk on the same sales date, or some subsequent date, as the selling officer may find convenient and advantageous. Should the last and highest bidder fail to comply with the terms of his bid within 30 days of final acceptance of his bid, then the selling officer shall re-advertise and resell the property under the same terms and at the bidder's risk on a subsequent sales day. Interest on the balance of the bid shall be paid to the date of compliance at the judgment rate. The Sale shall be subject to the first mortgage to MERS recorded in Book 2258 at Page 855, assigned to Bank of New York Mellon in Book 2812 at Page 1796 and in Book 3256 at Page 1429, and second mortgage to Bank of America recorded in Book 2457 at Page 2354 assigned to United Guaranty Residential Insurance Co. of NC in Book 2940 at Page 954, taxes and assessments, existing easements, easements and restrictions of record. Purchaser is to pay for the preparation of the deed, deed recording fees, and the costs of recording the deed. The sale will not be held unless Plaintiff or its attorney is preset at the Sale or has advised this office of its bidding instructions.
