TAKE NOTICE that a pleading seeking relief against you has been filed in the above-entitled action. The nature of the relief being sought is as follows: On or about October 2, 2018, William E. Ferguson ("Defendant") executed a Consumer Lending Plan (the "Consumer Lending Plan") with Founders Federal Credit Union ("Plaintiff"). Thereafter, subject to the Consumer Lending Plan, on or about October 3, 2018, Plaintiff extended a line of credit (the "First LOC") to Defendant as shown on a Preferred No Frills Visa Application and MasterCard terms and conditions (the "First LOC Note"). Defendant failed to make payments when due on the Consumer Lending Plan, the First LOC, and the First LOC Note. After providing all credits due to Defendant on the Consumer Lending Plan, the First LOC, and the First LOC Note, Defendant owes Plaintiff the sum of no less than $4,324.02, plus interest accruing thereon from and after the date of judgment at the lower of the maximum legal rate or the rate of the First LOC Note until paid and attorney's fees, pursuant to the Consumer Lending Plan, the First LOC, the First LOC Note, and N.C. Gen. Stat. § 6-21.2 in the amount of $648.60, which is 15% of the amount due under the Consumer Lending Plan, the First LOC, and the First LOC Note. Thereafter, subject to the Consumer Lending Plan, on or about January 14, 2022, Plaintiff advanced funds to Defendant as shown on a Security Agreement and Advance Receipt (the "First Note"). Defendant failed to make payments when due on the Consumer Lending Plan and the First Note. After providing all credits due to Defendant on the Consumer Lending Plan and the First Note, Defendant owes Plaintiff the sum of no less than $26,551.19, plus interest accruing thereon at the rate of $4.80 per day from and after April 24, 2025 until the date of judgment, and thereafter at the lower of the maximum legal rate or the rate of the First Note until paid and attorney's fees, pursuant to the Consumer Lending Plan, the First Note, and N.C. Gen. Stat. § 6-21.2 in the amount of $3,982.68, which is 15% of the amount due under the Consumer Lending Plan and the First Note. Thereafter, subject to the Consumer Lending Plan, on or about May 10, 2024, Plaintiff advanced funds to Defendant as shown on a Consumer Lending Plan Advance Receipt and Truth-in-Lending Statement (the "Second Note"). Defendant failed to make payments when due on the Consumer Lending Plan and the Second Note. After providing all credits due to Defendant on the Consumer Lending Plan and the Second Note, Defendant owes Plaintiff the sum of no less than $13,888.26, plus interest accruing thereon at the rate of $5.96 per day from and after April 24, 2025 until the date of judgment, and thereafter at the lower of the maximum legal rate or the rate of the Second Note until paid and attorney's fees, pursuant to the Consumer Lending Plan, the Second Note, and N.C. Gen. Stat. § 6-21.2 in the amount of $2,083.24, which is 15% of the amount due under the Consumer Lending Plan and the Second Note. Thereafter, subject to the Consumer Lending Plan, on or about March 21, 2024, Plaintiff extended a line of credit (the "Second LOC") to Defendant as shown on a Truth-in-Lending Disclosure Statement – Line of Credit (the "Second LOC Note"). Defendant failed to make payments when due on the Consumer Lending Plan, the Second LOC, and the Second LOC Note. After providing all credits due to Defendant on the Consumer Lending Plan, the Second LOC, and the Second LOC Note, Defendant owes Plaintiff the sum of no less than $2,763.03, plus interest accruing thereon from and after the date of judgment at the lower of the maximum legal rate or the rate of the Second LOC Note until paid and attorney's fees, pursuant to the Consumer Lending Plan, the Second LOC, the Second LOC Note, and N.C. Gen. Stat. § 6-21.2 in the amount of $414.45, which is 15% of the amount due under the Consumer Lending Plan, the Second LOC, and the Second LOC Note.
You are required to make defense to such pleading no later than January 26, 2026, said date being 40 days from the date of first publication of this notice, and upon your failure to do so the party seeking service against you will apply to the court for the relief sought.
