NOTICE OF TRUSTEE'S FORECLOSURE SALE OF REAL PROPERTY 25SP000524-590 Under and by virtue of the power and authority contained in that certain Claim of Lien filed on Ashley Nicole Birckbichler by Quail Run on Sharon Lake Condominium Association, Inc. dated September 12, 2024, and recorded in 24M004470-590 in the Mecklenburg County, North Carolina Registry, and because of default having been made in the payment of the indebtedness secured by said Claim of Lien, and pursuant to demand of the Owner and Holder of the indebtedness secured by said Claim of Lien, the undersigned Trustee will expose for sale at public auction to the highest bidder for cash the property therein described, to wit: Being known and described as all of Condominium Unit #31 Shady Oak Trail of Quail Run Condominium, as described and designated in the Declaration of Condominium under the North Carolina Unit Ownership Act covering said condominium, recorded in Book 4641, at Page 1, and any amendments or supplemental declarations thereto, and in Unit Ownership File #183, in the Mecklenburg County Public Registry. The address of the real property is as follows: 7945-31 Shady Oak Trail, Charlotte, NC 28210 The record owner of the property is: Ashley Nicole Birckbichler The terms of the sale are that the real property hereinabove described will be sold for cash to the highest bidder and that the undersigned may require the successful bidder at the sale to immediately deposit cash or a certified check in the amount of five percent (5%) of the high bid or $750.00 whichever is greater. An Order for possession of the property may be issued pursuant to N.C.G.S. § 45-21.29 in favor of the purchaser and against the party or parties in possession by the Clerk of Superior Court of Mecklenburg County. Any person who occupies the property pursuant to a rental agreement entered into or renewed on or after October 1, 2007, may, after receiving the Notice of Sale, terminate the rental agreement by providing written notice of termination to the landlord, to be effective on a date stated in the notice that is at least 10 days, but no more than 90 days, after the sale date contained in the notice of sale, provided that the mortgagor has not cured the default at the time the tenant provides the notice of termination. Upon termination of the rental agreement, the tenant is liable for rent due under the rental agreement prorated to the effective date of the termination. The real property hereinabove described will be sold "as is, where is" subject to any and all superior liens and encumbrances, including taxes and special assessments. The sale will be held open for ten (10) days for upset bids as by law required.
