(*PH) To align chapter with recent legislation, this rulemaking updates midwifery use of formulary drugs procedures, as well as approved continuing education hours and requirements for biennial birthdate licensure renewals. *24-3401-2601, Rules of the Idaho Board of Nursing. (*PH) Contemplated changes allow for biennial birthdate renewal of all board-issued licenses and advance the exception to licensure of nurse apprenticeship to nurse internship. IDAPA 31 – IDAHO PUBLIC UTILITIES COMMISSION PO Box 83720, Boise, ID 83720-0074 *31-0101-2601, Rules of Procedure of the Idaho Public Utilities Commission. These updates modernize filing and service requirements, align hearing procedures with current administrative standards, update outdated statutory references, and remove obsolete or duplicative provisions. 31-3601-2601, Policies and Presumptions for Small Water Companies. This chapter is being repealed due to outdated terminology and not aligning with current practice. The repeal allows the Commission to provide more accurate and appropriate regulatory treatment on a case-by-case basis. IDAPA 35 – STATE TAX COMMISSION PO Box 36, Boise, ID 83722-0036 *35-0101-2601, Income Tax Administrative Rules. These rule changes: eliminate the Idaho Child Tax Credit; rename and standardize the Food Tax Credit; align income-adjustment provisions with federal and state legislation; and revise the assessment timeline by removing outdated language concerning Federal Determinations so that the statutory period begins on the date of the IRS determination. Proposed rulemaking: establishes how existing allocation proportions will be divided among successor districts following when a school district, taxing unit, or urban renewal area splits, consolidates, or dissolves; changes primary residential exemption structure to prevent county assessors from mistakenly removing valid homeowner exemptions mid-year, which includes technical cleanup to match the new full-year timeline terminology; and omits obsolete language moved into state law for managing kilowatt hour tax exemptions on irrigation equipment. IDAPA 58 – DEPARTMENT OF ENVIRONMENTAL QUALITY 1410 N Hilton St, Boise, ID 83706 58.01.01 – Rules for the Control of Air Pollution in Idaho. *58-0101-2601, This rulemaking establishes general requirements and procedures for industries eligible to apply for an air quality general minor permit, which require minimal site-specific engineering analysis, intended to reduce administrative burden while ensuring compliance with applicable air quality standards and continued protection of public health and the environment. Comment by 10/2/2026. *58-0101-2602 (Fee Rule), This rulemaking updates the application and processing fees for new and modified facilities seeking a permit to construct, general permit, permit by rule, or Tier II operating permit and adds an annual fee for existing non-Title V facilities intended to account for inflation and to reduce program reliance on the State General Fund. Comment by 10/2/2026. *58-0101-2603, The Code of Federal Regulations incorporated by reference effective as of July 1, 2026, have been updated to maintain state primacy of Clean Air Act programs. These updates intend to revise and align the 1993 drinking water fees schedule with current and anticipated program operating costs allowing the Department to retain primary enforcement and regulatory authority. 58-0113-2502, Rules for Ore Processing by Cyanidation. To address ongoing public comments on alignment with enacted legislation, this rulemaking: updates definitions; clarifies preliminary design, pre-application and permitting processes and conditions; Issued For Construction data package criteria; cyanidation facility requirements; and updates to design criteria and alternative plans for facility process water and ponds.
