NASH, STEAD AND WILLITS.
AN ORDINANCE (CAR25-00019) FOR PROPERTY LOCATED AT 2607 N LANCASTER DRIVE BOISE, ID 83702; AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-2/HS-O/WUI-O (RESIDENTIAL: COMPACT WITH HILLSIDE DEVELOPMENT AND WILDLAND URBAN INTERFACE OVERLAYS) TO R-1B/HS-O/WUI-O (RESIDENTIAL: SUBURBAN WITH HILLSIDE DEVELOPMENT AND WILDLAND URBAN INTERFACE OVERLAYS); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That the land use zoning classification of the following described lands within the city of Boise City, Idaho, as set forth in Exhibits A (Map) and B (Legal Description) are amended and reclassified from R-2/HS-O/WUI-O (Residential: Compact with Hillside Development and Wildland Urban Interface Overlays) to R-1B/HS-O/WUI-O (Residential: Suburban with Hillside Development and Wildland Urban Interface Overlays), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare.
Section 2 The lands described in Section 1 hereof are subject to the Hillside Development and Wildland Urban Interface Sensitive Lands Overlay Districts and the standards in Boise City Code Title 11, Chapter 2, Section 7 as modified from time to time by Boise City ordinance.
Section 3. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement:
Reasoned Statement
The rezone from R-2 (Residential: Compact) to R-1B (Residential: Suburban) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05.4.I. (Zoning Map Amendment). The rezone would correct a technical mapping error. The existing parking lot crosses the western side property line onto the neighboring property, which is zoned R-2. A property line adjustment will be utilized to relocate the portion of the parking lot that crosses on to the neighboring property onto the subject property. The neighboring property is zoned R-2; thus, the property line adjustment itself would create a zoning inconsistency on-site. Therefore, the applicant is requesting to rezone this area of the property to match the zoning of the subject property, which alleviates both technical mapping errors. The ability of the political subdivisions that provide public services to the property to deliver those services effectively and efficiently is unaffected by resolving the mapping error. No new development is proposed to accompany the rezone and the request is to bring the site into conformance with the development code. Therefore, the proposed rezone is in the best interests of the public convenience and general welfare, and is compatible with the size, scale, height, density, and mobility of the surrounding development in that area, as the site borders similarly zoned properties to the north and east. Finally, multiple goals, principles, and policies within Blueprint Boise support the proposal. Establishing a coordinated and sustainable development within the Area of City Impact (AOCI) by aligning the site layout, property lines, and zoning designation in compliance with the development code reflects a clear and predictable development pattern and is supported by Goal PDP3 and NAC10. Doing so also retains a mix of housing types (Principle GDP-N.3 and Policy FH-CCN2.3) within the area, as the existing multifamily development reflects a cluster development which preserves open space, view Page 3 of 3 corridors, and transitions between development intensities within the foothills area (Principle GDP-N.10 and Policy FH-CCN 3.2).
Section 4. The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification therein described.
Section 5. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication.
