PUBLIC NOTICE OF INTENT TO PROPOSE OR PROMULGATE NEW OR CHANGED AGENCY RULES The following agencies of the state of Idaho have published the complete text and all related, pertinent information concerning their intent to change or make the following rules in the latest publication of the state Administrative Bulletin. The proposed rule public hearing request deadline is August 19, 2026, unless otherwise posted. The proposed rule written comment submission deadline is August 26, 2026, unless otherwise posted. IDAPA 08 – STATE BOARD OF EDUCATION PO Box 83720, Boise, ID 83720-0037 *08-0203-2603, Rules Governing Thoroughness. (Temp & Prop) (*PH) These rule changes establish a framework for determining eligible educational expenses for student participation in virtual instruction that include eligibility standards, expense categories, and limitations on non-allowable uses. Comment by 10/28/2026. IDAPA 24 – DIVISION OF OCCUPATIONAL AND PROFESSIONAL LICENSES PO Box 83720 Boise, ID 83720-0063 *24-0101-2601, Rules of the Board of Architects and Landscape Architects. (*PH) Rulemaking adds a certification fee and Seal language for Certified Interior Designers to comport with recently enacted legislation. *24-1001-2601, Rules of the State Board of Optometry. (*PH) Proposed changes remove the outdated Annual Fund fee, update continuing education credits, and reorganize and remove any outdated language from the rule chapter. *24-1301-2601, Rules Governing the Physical Therapy Licensure Board. (*PH) These rule changes update the minimum score required on the Test of English as a Foreign Language (TOEFL) in rule to reflect current scoring scale and update or remove existing outdated language. *24-1501-2601, Rules of the Idaho Licensing Board of Professional Counselors and Marriage and Family Therapists. (*PH) Edits decrease the direct supervisory hour requirements to reduce a regulatory burden on licensees. *24-3001-2601, Idaho Accountancy Rules. (*PH) Rule changes facilitate a new pathway to licensure for candidates, transition to birthdate-based renewals with an expanded window to accommodate peak tax season, and remove outdate language. IDAPA 34 – IDAHO SECRETARY OF STATE 700 W Jefferson St, EW205, Boise, ID 83702 34-0301-2601, Rules Implementing the Sunshine Law. These rule changes update outdated language and statutory references, as well as eliminate outdated sections that are no longer used by the agency such as Date Of Receipt and Expenditures Other Than Contributions. 34-0402-2601, Rules Governing Business Entity Names. These rule changes update outdated language and statutory references, as well as eliminate outdated sections that are no longer used by the agency such as Definitions. 34-0501-2601, Rules Governing Farm Products Central Filing System. These rule changes update outdated language and statutory references, as well as eliminate outdated sections that are no longer used by the agency such as Abbreviations; Registration Of Buyers, Commission Merchants, & Selling Agents -- Subscription To The ML; and Requests For Information. Additional changes reorganize tables for Fees and Collateral Information Codes, as well as clarify requirements for Farm Products Financing Statements. 34-0502-2601, Rules Governing Liens in Crops for Seed or Liens in Crops for Farm Labor. These rule changes update outdated language and statutory references, as well as streamline information for forms, notices, amendments, assignments, extensions, releases, lists, searches, and fees related to lien claims. 34-0503-2601, Requests for Information – Form UCC-4 – Fees. This rulemaking proposes to repeal IDAPA 34.05.03. 34-0506-2601, Rules Governing Lien Filings Under the UCC. These rule changes update outdated language and statutory references for the filing, acceptance, indexing and searching of financing statements in the Secretary of State's Office under Article 9 of the Uniform Commercial Code. 34-0601-2601, Rules Governing the Electronic Recording of Real Property. This rulemaking proposes to repeal IDAPA 34.06.01. IDAPA 58 – DEPARTMENT OF ENVIRONMENTAL QUALITY 1410 N Hilton, Boise, ID 83706 58-0102-2601, Water Quality Standards. This rulemaking revises three and adds two additional site-specific aquatic life criteria for selenium and makes several administrative updates to IDAPA 58.01.02. Comment by 09/04/2026. 58-0105-2601, Rules and Standards for Hazardous Waste. This proposed rule ensures state rules remain consistent with federal regulations implementing the Resource Conservation and Recovery Act as directed by the Idaho Hazardous Waste Management by updating documents incorporated by reference with the July 1, 2026, Code of Federal Regulations, and also adjusts time period when granting a variance.
