NOTICE OF FORECLOSURE SALE OF TRANSFERABLE LLC
INTEREST OF COMPANY HOLDING PRODUCTION ROYALTY
IN QUARTZBURG MINING DISTRICT
NOTICE IS HEREBY GIVEN that pursuant to the Order Granting Motion to Foreclose on Charging Order Lien and Order Authorizing Sale of Defendant Donald E. Miller's Transferable Interest in Millerton
Legacy, LLC, entered August 26, 2025, in the District Court of the Fourth
Judicial District of the State of Idaho, in and for Ada County, Idaho, Case No. CV01-23-12018, Andrew E. Hawes, Judgment Creditor and foreclosing party, will sell at public auction all transferable interest of Donald E. Miller in Millerton Legacy, LLC, an Idaho limited liability company. Donald E. Miller purports to own a 90% interest in the company. The sale is being conducted to satisfy the charging order lien securing the judgment in favor of Andrew E. Hawes and against Donald E. Miller in the amount of $188,294.08, plus accrued interest at 5%, costs, attorney fees, and any other amounts allowed by law or court order.
The sale will be held on September 3, 2026, at 10:00 a.m. Mountain Time, at the front steps of the Ada County Courthouse, 200 W. Front Street, Boise, Idaho 83702. The sale may be postponed, continued, or adjourned to a later date, time, and place by public announcement made at the scheduled sale.
The property being sold is not real property. The sale is limited solely to the transferable interest of Donald E. Miller in Millerton Legacy, LLC, subject to the Operating Agreement of Millerton Legacy, LLC, the Idaho Limited Liability Company Act, the Court's foreclosure order, and all other applicable law. The purchaser shall acquire only such economic rights and other rights, if any, as are transferable under applicable law and the Operating Agreement, and shall not acquire any greater rights than those held by Donald E. Miller.
Millerton Legacy, LLC is identified as owner of rights associated with the Deed of Royalty Quartzburg Mining District, recorded as Instrument No. 237870 in the official records of Boise County, Idaho, on December 28, 2012, involving a production royalty on certain patented and unpatented mining claims and other real property interests located in Boise County, Idaho, including 19 patented mining claims located in Sections 3, 9, and 10, Township 7 North, Range 4 East, Boise Meridian, Boise County, Idaho, all as more particularly described in the recorded Deed of Royalty. This reference is provided for informational purposes only; the sale is only of Donald E. Miller's transferable interest in Millerton Legacy, LLC and is not a direct sale of the Deed of Royalty, any mining claim, mineral estate, royalty deed, or real property.
Bids may be made in an amount less than the total judgment amount. Bidders other than the Judgment Creditor exercising a credit bid must present, before bidding, an original cashier's check issued by a federally insured financial institution and made payable to Andrew E. Hawes in an amount equal to or greater than the bidder's intended maximum bid. The Judgment Creditor reserves the right to enter a credit bid, in whole or in part, up to the amount of the judgment, accrued interest, costs, attorney fees, and any other amounts allowed by law or court order.
The transferable interest is sold "as is, where is, with all faults," without representation or warranty of any kind, express or implied, including as to ownership percentage, value, title, transferability, company records, company assets, royalty income, mining claims, mineral rights, tax consequences, membership status, or any other matter. Prospective bidders are solely responsible for their own due diligence before bidding.
