ORD-29-26 OF THE CITY OF BOISE CITY, IDAHO PUBLIC NOTICE IS HEREBY GIVEN that the city of Boise City, Idaho, adopted at its regular meeting of June 30th, 2026, that Ordinance No. ORD-29-26 entitled: ORDINANCE STRIKING CHAPTER 3, ENTITLED "RESTAURANTS" FROM TITLE 4 OF THE BOISE CITY CODE ("BCC'); ENACTING A NEW CHAPTER 5 TO TITLE 3 OF BCC, ENTITLED "FOOD AND BEVERAGE ESTABLISHMENTS," WHICH IS AN AMENDED AND MOVED VERSION OF THE STRUCK BCC TITLE 4, CHAPTER 3; UNDER SUCH NEW CHAPTER PROVIDING THE LEGAL AUTHORITY, PURPOSE, AND SCOPE FOR FOOD AND BEVERAGE ESTABLISHMENT LICENSES (PREVIOUSLY REFERRED TO AS EATING AND DRINKING LICENSE); SETTING FORTH THAT THE GENERAL LICENSING PROVISIONS ARE APPLICABLE; PROVIDING DEFINITIONS; SETTING FORTH LICENSE REQUIRED, LICENSING EXEMPTIONS, APPLICATION REQUIREMENTS, AND LICENSE TERM; PROVIDING LICENSE STANDARDS AND REQUIREMENTS; SETTING FORTH LICENSE DENIAL, SUSPENSION, AND REVOCATION REVIEW PROCEDURES; PROVIDING A PENALTY PROVISION; AMENDING BCC TITLE 3, CHAPTER 2, ENTITLED "VENDORS, SOLICITORS, TEMPORARY MERCHANTS" TO ALIGN WITH NEW STATE CODE AND WITH NEW BCC TITLE 3, CHAPTER 5; AND AMENDING BCC TITLE 3, CHAPTER 1, ARTICLE A, SECTIONS 3, 4, AND 6, AND BCC TITLE 3, CHAPTER 4, SECTION 7 TO ALIGN WITH NEW BCC TITLE 3, CHAPTER 5; PROVIDING FOR A WAIVER OF THE READING RULES; APPROVING A SUMMARY OF THE ORDINANCE; AND PROVIDING AN EFFECTIVE DATE. This ordinance strikes Chapter 3, entitled "Restaurants" from Title 4 of the Boise City Code. The ordinance enacts a new Boise City Code Title 3, Chapter 5, entitled "Food and Beverage Establishments," which is and amended and moved version of the struck Boise City Code Title 4, Chapter 3. The ordinance, under the new Title 3, Chapter 5, provides the legal authority, purpose, and scope for Food and Beverage Establishment Licenses (previously referred to as Eating and Drinking Licenses). It sets forth in the new Title 3, Chapter 5, definitions and that the general licensing provisions are applicable. This ordinance sets forth that a Food and Beverage Establishment License is required, licensing exemptions, application requirements, and the term of such license. The ordinance provides license denial, suspension, and revocation review procedures. It also provides a penalty provision for the new Title 3, Chapter 5. This ordinance also amends Boise City Code Title 3, Chapter 3, entitled "Vendors, Solicitors, Temporary Merchants" to align with newly adopted state code and with the new Boise City Code Title 3, Chapter 5. The ordinance amends Boise City Code Title 3, Chapter 1, Article A, Sections 3,4, and 6 and Boise City Code Title 3, Chapter 4, Section 7 to align with the new Boise City Code Title 3, Chapter 5. The ordinance provides for a waiver of the reading rules, establishes an ordinance effective date, and approves this ordinance summary. The effective date of the Ordinance is the date of its passage, approval and publication. A copy of the full text of the Ordinance is available at the City Clerk's office, 150 North Capitol Boulevard, in Boise, Idaho 83701. Examination may be requested in writing or in person during regular business hours of the City Clerk's office, from 8:00 a.m. until 5:00 p.m. pursuant to Idaho Code Title 50, Chapter 9, Section 01A(4).
