Ordinance NO. ORD-25-26 BY THE COUNCIL CORLESS, HALLYBURTON, MORALES, NASH, STEAD AND WILLITS. AN ORDINANCE (CAR25-00015) FOR PROPERTY LOCATED AT 3412 AND 3414 S LINDSAY AVENUE AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION 1 OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM I-1 (LIGHT INDUSTRIAL) TO R-2 (RESIDENTIAL: COMPACT) SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE. BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO: Section 1. That the land use zoning classification of the following described lands within the City of Boise City, Idaho, as set forth in Exhibits A (Legal Description) and B (Map) are amended and reclassified from I-1(Light Industrial) to R-2 (Residential: Compact), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare. Section 2. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement: Reasoned Statement The proposed rezone from I-1 (Industrial: Light) to R-2 (Residential: Compact) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05-4.I (Zoning Map Amendment). The subject property and adjacent industrial uses to the south are isolated from the larger commercial and industrial area to the east by the Union Pacific Railroad which is elevated on the berm along the east side of the property. This railroad creates a barrier and limits site access through the adjacent residential neighborhood to the north. As such, rezoning the 3.07-acre east side of the subject property from I-1 to R-2 will allow the subject property to be developed as a cohesive residential project development on the overall subject property with access through the residential neighborhood. In addition, the rezone from I-1 to R-2 will protect the existing residential neighborhood to north and west from impacts associated with the existing or potential industrial redevelopment since the primary access to the site is through the adjacent residential neighborhood. There has been a change to the conditions and circumstances within the surrounding area. The larger residential neighborhood to the north of the subject property has and is anticipated to experience a significant amount residential infill development, which is not compatible with the existing industrial uses. Section 3. The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification therein described. Section 4. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication. ADOPTED by the Council of Boise City, Idaho, on June 23, 2026.
