AN ORDINANCE (CAR25-00017) FOR PROPERTY LOCATED AT 1907 W JEFFERSON STREET AMENDING ZONING CLASSIFICATIONS OF THE CITY OF BOISE CITY TO CHANGE THE CLASSIFICATION OF REAL PROPERTY PARTICULARLY DESCRIBED IN SECTION ONE OF THIS ORDINANCE AND ADJACENT RIGHTS OF WAY FROM R-2 (RESIDENTIAL: COMPACT) AND R-3 (RESIDENTIAL: URBAN) TO MX-1 (MIXED-USE: NEIGHBORHOOD); SETTING FORTH A REASONED STATEMENT IN SUPPORT OF SUCH ZONE CHANGE; AND PROVIDING AN EFFECTIVE DATE.
NOW THEREFORE, BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF BOISE CITY, IDAHO:
Section 1. That the land use zoning classification of the following described lands within the city of Boise City, Idaho, as set forth in Exhibits A (Map) and B (Legal Description) are amended and reclassified from R-2 (Residential: Compact) and R-3 (Residential: Urban) to MX-1 (Mixed-Use: Neighborhood), pursuant to the procedures and requirements of Idaho Code Title 67, Chapter 65 and Boise City Code Title 11, Chapter 5, and the Boise City Comprehensive Plan, as a result of changed circumstances and to promote the public health, safety, and welfare.
Section 2. Pursuant to Idaho Code § 67-6535, the Boise City Council hereby adopts the following Reasoned Statement:
Zoning Map Amendment
The proposed rezone from R-2 (Residential: Compact) and R-3 (Residential: High Density) to MX-1 (Mixed-Use: Neighborhood) is consistent with the approval criteria of Boise City Code (BCC) Section 11-05-05-4.I (Zoning Map Amendment). The subject property is designated as "Compact" and "High Density" within which the MX-1 zone is allowed. The proposal is compatible with the adjacent single-family residences and provides additional housing and commercial uses within the Boise city limits, reducing vehicle miles traveled as supported by the comprehensive plan (Policy CC1.1). The subject property is located near other employment areas and services, as well as designated bikeways and bus lines where increased density is supported. As proposed, the rezone would provide an additional mix of housing and neighborhood-scale commercial uses, with pedestrian-oriented streetscapes, as encouraged by Blueprint Boise Principles IDP-MU.1 and GDP MU.2.
Section 3. The zoning maps of the city of Boise City, Idaho, are hereby changed, altered, and amended to include and insert the real property described in Exhibits A and B hereof in the land use classification therein described.
Section 4. That this Ordinance shall be in full force and effect from and after its passage, approval, and publication.
